Jesser Director of Administrative Services 309 Administration Building Colorado State University - Fort Collins, CO 80523 Dear Mr. Jesser, The City of Fort Collins is interested in annexing a piece of property it owns, approximately 320 acres in size, located just west of Interstate Highway 25 and south of Prospect Road. This property is presently being used and operated as a sludge farm. Because the property is not presently contiguous to existing municipal boundaries, several other properties would need to be annexed before annexation of the sludge farm could be possible. One such property, commonly known as the Northern Colorado Nature Center, approximately 80 acres in size, is owned by the State Board of Agriculture. I have had several discussions with Mr. Robert H. Burnham of your staff, and Dr. Howard Alden, Nature Center Director, about the potential annexation of the SBOA property. The discussions were generally favorable towards annexation. Recently, Mr. Burnham and I discussed several items the State Board of Agriculture would like to attach as conditions of any annexation of the Nature Center property. Mr. Burnham has forwarded to me a copy of your June 11, 1986, letter to Ms. Lucia Liley, containing conditions which have been applied to other SBOA property annexed into the City of Fort Collins. Mr. Tom Peterson, Planning Director, Mr. Steve Roy, Assistant City Attorney, and I reviewed the conditions as stated in your June 11, 1986, letter and have added a slight modification which has been attached for your review. , a 3 OFFICE OF COMMUNITY 300 LaPorte Ave. • P.O. Box 580 Fort Collins, Colorado 80522 (303) 221-6750 DEVELOPMENT, PLANNING DIVISION The City of Fort Collins would like to immediately begin a process which will eventually lead to the annexation of the sludge farm. The first step of the process would be for the State Board of Agriculture to annex the Nature Center property. City staff is willing to recommend approval to the Planning and Zoning Board and the City Council of an Annexation Petition from the State Board of Agriculture for the Nature Center property with an annexation agreement outlining the conditions as set forth in the enclosed attachment. Tom Peterson, Planning Director Conditions for the Annexation of the Northern Colorado Nature Center Modification shown in CAPITAL letters. Petitioner specifies as a condition of the proposed annexation that the proposed annexation in no sense shall be interpreted as: (1) conveying to said City any right, title or interest in the property so annexed; (2) conveying any right to establish new streets or extend existing streets upon or across said property, or to construct utility lines of any kind upon or across said property; (3) granting any right to apply the provisions of any municipal ordinance, and specifically any building code, zoning code, or licensing ordinance, upon the property so annex so long as title shall remain in the State Board of Agriculture AND SO LONG AS THE SUBJECT PROPERTY CONTINUES TO BE USED EXCLUSIVELY AND DIRECTLY FOR EDUCATIONAL PURPOSES; provided, however, that the jurisdiction of the City of Fort Collins shall extend over the property annexed insofar as it relates to the application of: .(1) city traffic ordinances; (2) city ordinances relating to police enforcement of the traffic code, city ordinances relating to offenses against the person, offenses against public peace, offenses relating to morals, and offenses relating to public health and safety, and (3) the jurisdiction of the municipal court is extended to include violations of ordinances included in the foregoing items 1 and 2 of this paragraph occurring on the lands so annexed; provided, however, that nothing contained in the annexing ordinances shall be construed to limit the authority of the University officials to impose upon its students and employees any supplemental traffic regulations or restrictions or to impose such other penalties as are consistent with their status with respect to the University.
