Collins, Colorado 80521 HMING AUMORN June 2, 1988 Ms. Sherry Albertson -Clark Senior City Planner City of Fort Collins 300 LaPorte Ave. Fort Collins, Colorado 80522 Re: Mountain Park Homes - Alley Improvements Dear Sherry: Telephone (303) 221-5484 I have been provided with a copy of your May 24, 1988 letter to Jim Kline regarding the proposed language on the mylar which would have the Fort Collins Housing Authority participate in future alley improvements at such time as an improvement district may be formed. We were unaware of a requirement that we must place the language you suggest on our documents. Was this a condition of the Planning and Zoning approval? Our difficulty in complying with your request is to be found in 29-4-226, C.R.S, as amended. 29-4-226. Exemption from special assessments. A housing authority shall be exempt from the payment of any special assessments to the state or any subdivision thereof. The property of a housing authority shall be exempt from all local and municipal special assessments. All Property leased to a housing authority shall likewise be exempt from special assessments. Do we have a conflict with a City ordinance which requires us to include the language you suggest? I mentioned these concerns to Steve Roy with hope that we might resolve the matter without undue delay to the project. As I will be on vacation for two weeks, Jim Kline will work with you on resolving the matter. But, I cannot authorize the inclusion of the language at this time. Thank you for your continued support.
