Dear Eldon,
This letter is simply meant to make sure that certain issues with respect to the Interstate Land PUD,
First Filing (Harley Davidson), Final have been clearly stated and are understood. The few
outstanding concerns are briefly listed/described below:
The Boxelder Creek bank stabilization, transitioning, and water line crossing.
2. The site access, lane transitioning, and State Highway Access Code standards.
3. The traffic study, submitted on March 12, 1996, states that "Based upon State Highway Access
Code criteria, a westbound right -turn auxiliary lane and an eastbound left -turn auxiliary lane are
required on Prospect Road at the Frontage Road intersection, using the traffic shown in
Appendix D ... A westbound right -turn acceleration lane is required on Prospect Road. This
lane would leave the CDOT right-of-way just west of the Frontage Road."
The feeling amongst staff is that, if this project is to stay on the April 22nd Planning and Zoning
Board agenda, it's probably too late to finish any designs for these improvements or have such
designs reviewed in time. Rather, staff would condition the recommendation of approval on
the necessary improvements being made as part of this development (details to be addressed
through the development agreement process). That is, completion of all necessary
improvements would be a condition of approval. This condition would be necessary as staff
is not willing to support a variance from these requirements. However, if for some reason this
project gets continued for another month, we would hope the design of the necessary
improvements could be worked out during the resulting time span.
4. I received a phone call from Mr. Don Magnuson of the New Cache La Poudre Irrigation
Company/The Cache La Poudre Reservoir Company this morning. As of this morning, March
29th, Mr. Magnuson stated that there is "no way" he would be willing to sign -off on/approve
the site plans as currently drafted. His concerns centered around access to the ditch as well as
the proximity of the proposed building.
Hopefully, we can discuss and at least begin to resolve these issues together at the meeting scheduled
for 2:00 p.m. on Monday, April 1. If you should have any questions regarding these comments or if I
