The Cac_^.e La Poudre Reservoir Company exists in Larimer Count-7 for
the purpose of servicing stockholders with irrigation waters.
The Cache La Poudre Reservoir Company was not notified of t::e _ _anz
of the Intarstate Land PUD.
A major concern of The Cache La Poudre Reservoir Company is _,cass
to the canal for maintenance and operation. This at tires -�:gyres
wider access than a mere roadway for the use of hea-,y equ:.p ;e_ a
place to temporarily store maintenance material and adequate space
to allow excavation operations with minimal interference. We have
become especially concerned about this issue due to poor access
that exist along current residential sections. The Cache La Poudre
Reservoir Company has two major canal structures on the northwest
and northeast corners of Lot 8 of the Interstate Land PUD. It is
a concern to have adequate access to these structures. The Cache
La Poudre Reservoir Company is requesting a one hundred (100) foot
easement along the whole north end of Lot 8.
One plan that has been utilized in development along the canal
system has been to leave a green belt parallel to the canal
easement. A green belt area is designated as part of the covenants
of the development and regulations written specifying that only
native grasses are ever to be seeded in the green belt area. We
request that the utility easement which parallels the canal
easement be designated as a green belt and that only native grasses
be allowed in_this area. It is our opinion that, i,f the covenants
and restrictions are clear in defining the green belt, both the
operational goals of The Cache La Poudre Reservoir Company and the
goals of the neighboring development are met without creating
future cause for friction.

Another concern of The Cache La Poudre Reservoir Company is the
additional exposure of the canal system to people. Exposure to
water delivery and storage systems creates a considerable amount of
risk. The Cache La Poudre Reservoir Company is of the opinion that
development along the system should not increase our liability. It
is the hope of The Cache La Poudre Reservoir Company that those who
choose to develop along the canal system and those who choose to
neighbor along the canal system will take such precautions as are
reasonable to develop safety measures within their own real
property and accesses.
The Cache La oudre Reservoir Company supports t he rights of
neighboring property owners to develop their property in an order'y
manner consistent with the county and local master plans. It is
the opinion of The Cache La Poudre Raser-✓oir Company that this is
a well planned development. We recuest that a clear, tree =ree
canal access be restricted to native grasses by covenant.
If it is necessary for any services to cross the canal right-of-way
such as utilities, it will be necessary for each entity to contact
The Cache La Poudre Reservoir Company office for a crossing
agreement. For those crossings which are apparent during the
planning process, the crossing agreements will have to be in place
before The Cache La Poudre Reservoir Company signs off on the -inal
plans. For those crossings which are initiated after the approval
of the plans, the crossing agreements must be in place before any
work is initiated.
Please keep The Cache La Poudre Reservoir Company informed
regarding any meetings or plans pertaining to this development.
