On January 8, 1996, a motion by the Planning and Zoning Board to approve the
Interstate Land Preliminary PUD failed on a 3 - 3 vote. This letter represents an appeal of that
action. The appellant is the owner of the subject property:
Overlook Farm Inc.

The grounds for appeal are that relevant laws were not properly iirterpreted and applied
by the Planning and Zoning Board. The three Board mernbers voting against the Preliminary
PUD indicated concerns about existing traffic problems in the greater area, specifically on
Summit View and Prospect, and about using the adopted Master Street Plan as the basis of
the Traffic Study.
* This is not an appropriate reason to deny a proposed PUD. A PUD clearly cannot be
denied because it is based on the adopted Master Street Plan and other elements of the
Comprehensive Plan.
The appellant therefore respectfully asks that you overturn the d°acision of the Planning
and Zoning Board.
