Robert Hardt, Phillips Petroleum Keene Smith, K/Z Enterprises Tom Peterson, City of Fort Collins FROM: Rex Touslee, State of Colorado, Division of Highways DATE: February 5, 1988 RE: Consensus of Parties Directly Affected by Design of the Interchange at I-25 and Prospect Road It is our understanding that the five parties involved in our discussions of the design of the Northwest Quadrant of the Prospect/I-25 interchange: The State Division of Highways, the City of Fort Collins, G. T. Land, Phillips Petroleum, and K/Z Enterprises have reviewed three alternative approaches to the alignment of the frontage road at this location. It is further understood that the consensus of those parties is that Alternative "C" - the "Preferred" Frontage Road Alignment (see attached copy) is the desired alternative, with the following conditions: - Overlook Farm Inc. (the property managed by G. T.) will dedicate the 80-foot wide right of way for the realigned frontage road. - Overlook Farm will also provide a mutually acceptable access easement from the proposed frontage road to the northerly portion of the Phillips and K/Z properties. - The Phillips and K/Z properties will be allowed a shared right-in/right-out access to their properties from. Prospect Road. - Other reasonable access from the frontage road in the general locations shown on the attached Development Concept Plan (exact locations may vary slightly with final development plans) will also be allowed. Any additional access needs will be determined through the review of Traffic Impact Analyses to be provided by the applicant at the time of specific development proposals and the Division of Highways' Access Code in effect at the time of application for access. We feel that, if the above items are covered in the instrument dedicating the frontage road right of way, no further documents need to be prepared, and work on the design and construction of the interchange and the frontage road can continue immediately. Pursuant to changes mandated by the Surface Transportation and Uniform Relocation Assistance Act of 1987 the Department would like to request a change in the pro -ration for the project to reflect the value of the donated parcels, or whatever other bookkeeping method might apply. The appraisals were all done without consideration of either damages or benefits which is consistent with the law. They were done according to Title III of the Uniforms Act, as amended and a Fair Market Value was set. All donations were from the private sector and were received after April 2, 1987. Following is a breakdown of the parcels involved and I have included a copy of the donation forms and the Fair Market Values to aid you: Parcel 1, AC-1, 1R - Sandy Investment Co.
