Dear Marc,
This letter will serve as clarification of the City's position on various issues which you
raised at a June 4, 1996 meeting with City Staff regarding the City's Interdepartmental
Comment Letter to you dated May 17, 1996.
First, Comments #8a and #8c by the City Forester requested that the parkway strips
along Manhattan and Horsetooth be irrigated and that Landscape Note #3 be deleted
as the adjoining property owners or homeowners association will be responsible for
maintaining existing and proposed landscaping in the public right-of-way. At our June
4, 1996 meeting, you pointed out that paragraph 3(d) of your February 8, 1991,
Settlement Agreement with the City (°the Settlement Agreement") states that "the City
will maintain the said portion of Dennison Avenue, as well as Horsetooth Road and
Manhattan Avenue." After reviewing the Settlement Agreement, the City agrees with
your position and therefore, the requests of comments #8a and #8c should be
disregarded.
Second, Comments #2a , #9c, and the Engineering and Stormwater Utility comments
on the Project Comment sheets attached to the City's May 17 letter are valid as the
proposed plan has modified the originally approved drainage design under the
County's previous subdivision approval of your property. Paragraph 3(c) of the
Settlement Agreement states that changes may be made "...provided that any such
change in location is approved by the City's Manager of Stormwater Utility, and so long
as any such change would not diminish the quantity or rate of flow of storm waters
presently delivered onto the Exhibit A Property." The City, therefore, has the right to
approve the proposed changes with a condition that the applicant install a concrete
drainage pan along Manhattan Avenue.
Finally, it is the City's belief that by filing with the City and receiving approval for an
Overall Development Plan and two P.U.D.'s concerning your property, which ODP and
PUD's differ significantly from the previously approved County subdivision for your

property, the right to develop the remaining portion of the property in accordance with
the County approved plat has been waived. Therefore, the proposed Park South
O.D.P. amendment and Park South PUD, 3rd Replat are subject to the City ordinances
and policies that were in effect at the time the development application was submitted
(April 22, 1996).
