Re: Lots 99 through 112, PARK SOUTH P.U.D.
Dear 11r. Frazier:
Please be advised that this lawfirm represents Stonybrook North,
Inc., a Colorado Corporation, with respect to the purchase of
certain real property known as Lots 99 through 112, PARK SOUTH
P.U.D., from Greyrock Development Company, a joint venture
composed of Loren J. Dilsaver, willene B. Dilsaver, Emma Lue
Strahle, Ronald 11. Strahle, and Dilsaver Development Company.
The sellers have warranted and agreed to several matters which
relate to the planning, zoning, and subdivision requirements of
the City of Fort Collins. I am writing this letter to confirm
that the warranties and representations made were and are true
and correct, and that the agreements can be performed. I hereby
request a letter from the office of the City Attorney on behalf
of the City of Fort Collins with respect to the following matters
relative to PARK SOUTH P.U.D. generally, and Lots 99 through 112
PARK SOUTH P.U.D. specifically:
(a) Please confirm that the requirements of the City of Fort
Collins which are conditions precedent to the construction of
dwellings upon Lots 99 through 112, PARK SOUTH P.U.D., have been
met, and that Building Permits will be issued upon prover
application by Stonybrook North, Inc., to the City of Fort Collins.
(b) Please specify any requirements of the City of Fort Collins
which are conditions precedent to the construction of dwellings
upon the remaining portion of PARK SOUTH P.U.D.
(c) Please confirm that the requirements of the City of Fort
Collins for raw water and storm drainage have been satisfied
with respect to Lots 99 through 112, and with respect to the
remainder of PARK SOUTH P.U.D., and that no additional costs or
fees will be required from Stonybrook North, Inc., by the City
of Fort Collins with respect to these items.

(d.) Please confirm that to the City of Fort Collins' best
knowledge and belief all water, sewer, service lines and
electrical mains are in compliance with any and all require-
ments of the City of Fort Collins.
(e) Please confirm that asphalt paving in and on Manhattan
Avenue, and in or on that portion of Boulder Street as it
exists at this time, have been constructed in accordance with
the requirements and specifications of the City of Fort
Collins, and have been accepted by the City of Fort Collins
for maintenance.
(f) Please confirm that Stream Court has been built in
accordance with the requirements and specifications of the
City of Fort Collins.
(g) Please confirm that the above referenced sellers have
fully paid for the construction and installation of Manhattan
Avenue, and that the City of Fort Collins has installed a
12" ductile iron water main thereunder. Also, please explain
what arrangements have been made between the City of Fort Collins
and the above referenced sellers with respect to the payment of
sellers' portion of the costs of such water main. Please confirm
that at the time the 12" water line was installed under Manhattan
Avenue, the City and first party agreed that ductile iron
pipe would be installed under Manhattan Avenue, and the remainder
of Park South P.U.D., as platted, and that the City of Fort
Collins would credit the difference between the installed cost
of ductile iron pipe and PVC pipe to the above referenced sellers
against their share of the cost of the water line under Manhattan
Avenue.
(h) Please provide this office with a copy of any and all
agreements currently in effect with respect to the development
of Park South P.U.D. With respect to such agreements, please
confirm that they were duly and properly executed by and binding
upon the City of Fort Collins. Also, please confirm that such
agreement or agreements set forth the entire requirements with
respect to the development of Park South P.U.D., or, if this is
not the case, please provide this office with specific
enumeration of the development requirements and standards which
will in any way relate to the development of Park South P.U.D.

(i) Please confirm that the Plat of South Park P.U.D. is duly
and validly executed, recorded, and binding upon the City of
Fort Collins,and that development of Park South P.U.D. may
proceed in accordance with the Plat.
(j) Please provide this office with any further or additional
information which you believe may relate to or impact upon the
development of Park South P.U.D.
Stonybrook North, Inc., will be relying upon the matters received
in response to this letter with respect to the acquisition and
development of Park South P.U.D.
Your cooperation and assistance in this matter is greatly
appreciated by all of the parties referenced in this letter.
Hopefully you will be able to respond prior to April 27, 1984.
Should you have any questions or comments regarding any of the
matters set forth herein, please do not hesitate to contact
this office at your convenience. Thank you for your prompt
attention to this matter.
