Jesser CPM Director of Administrative Services Colorado State University 309 Administration Building Fort Collins, CO 80523 Dear Mr. Jesser, In response to the questions raised at the Physical Development Committee meeting of April 6, 1988, regarding the possible annexation of certain property owned by CSU, including the foothills stadium, please be advised of the following: I. If the Council concurs, the university could be exempt from certain City codes which could include building and zoning bodes. Specific exemptions should be specified in the annexation ordinance, along with a statement concerning local laws which will apply to the property, such as the Model Traffic Code, as amended. 2. City sales tax will be required in any instance where state sales tax is currently being collected. 3. Law enforcement will continue to be the responsibility of the university, as is true for the main campus. 4. Herbicide and pesticide use will continue to be regulated by state and federal law. We believe most enforecement is accomplished at the County level, the City has no present regulation on this subject. 5. The university police would be responsible for the enforcement of state liquor laws. The Foothills stadium would be under the jurisdiction of the City Liquor Licensing Board. Explosive storage will continue to be regulated by the university. 7. Hazardous materials storage will continue to be regulated by the university. 8. The City staff would support annexation language used in the past by the university. I trust this information is sufficient for your purposes.
