Fort Collins, CO 80525 RE: Hewlett-Packard Meeting Tom, The purpose of this letter is to serve as a recap of our meeting on Tuesday, November 10, concerning the remaining permit options and status of fees associated with the new H-P fabrication facility under construction. City of Fort Collins staff will reconcile City fees currently collected with those, if any, that remain outstanding for the project based on the following two options summarized below. OPTION A A final building permit will be issued for the fully operational manufacturing project as originally submitted through to final building occupancy. However, primary construction activities may cease for some period of time after the exterior building shell is completed. If construction ceases at such stage, the building will not be required to be fitted with a fully automatic fire -sprinkler system if it remains unoccupied and is used only for unheated low - hazard noncombustible storage -- classified by the 1997 UBC as a Group S, Division 2 Occupancy, and as further stipulated by the Poudre Fire Authority. By selecting "Option A", the permit holder must pay the balance, if any, of City fees that have been identified as being due for issuing the final building permit for the entire original completed project. Work may continue at the owner's discretion subject to the expiration limitations as stated in Sec. 106.4.4 of the 1997 UBC. Under the UBC provision, if the construction is suspended for 180 days but less than a year, the permit will expire and a new building permit must be issued at one-half of the original building permit fee before construction may resume. Previously paid plan review fees are not subject to a renewal assessment, provided that no changes are made or significant applicable building code changes are enacted. If the work is suspended for more than a year, a new building permit must be obtained with payment of the full building permit fee before the work may resume with the same conditions on the plan review fees as previously stated. A one-time 180-day extension will be authorized upon written request with no additional fees provided the request is received before the 180-day expiration deadline. Additionally, City staff must perform "progress" inspections in order to verify that construction work has not been suspended for 180 days or longer. Page 2 Tom Peterson Tek Shepard - TPeterson-HP.doc Am Am Page 2 OPTION B An amended final building permit with a revised construction value will be issued authorizing the current construction through to the exterior completed building shell only, as described in "Option A". Any plan review fees collected for work that will no longer be included in the revised project description will be either refunded or credited toward other final City fees that are determined due. At such time as the owner wishes to complete the interior finish of the building for fabrication or other purposes, an entirely new permit must be obtained with payment of all applicable building permit and plan review fees for the interior finish work. Although we discussed that the previously paid plan review fees would be applicable to the finished project when it is resumed, the refund or credit method described above is the cleaner accounting approach. It offers the most flexibility and will simplify issuing the interior finish permit when the time comes, without attempting to anticipate unforeseen complications like a code change or a significant redesign by the owner. In any case, if the fully operational final project as originally submitted is suspended upon completion of the exterior building shell, the site must be completed to the interim functional degree previously discussed with H-P representatives at our October 2 meeting, and as yet to be stipulated in a "Minor Amendment" to the Preliminary Development Plan. The Minor Amendment will address site improvements such as landscaping, erosion control, paved surface materials for emergency equipment access, storm water control, lighting, etc. Contact me for further assistance or clarification.
