Steve Wolley requested the meeting to discuss the process for suspending work on the fabrication facility currently
under construction on the Hewlett-Packard campus in Fort Collins. The date of resumption of construction is
unknown but would probably not be within the year and may be as distant as three years from now.
Mr. Wolley asked for direction on what minimum site work and building construction would be expected prior to
suspension of work. He proposed that the storm drainage work be completed, the site be graded and seeded with
dryland grass, hard surface access for fire apparatus be provided around the building and the exterior of the building
be fmished. No utilities will be provided to the building. The only use of the building would be for storage of
construction materials for the building itself on the lower floors.
Peter Barnes suggested that the appropriate land use process would be for Hewlett-Packard to apply for an
amendment to the approved site plan (Preliminary Development Plan) showing the proposed locations of paved
areas and grassed areas and location and type of site lighting during the suspension period of the project. A
narrative describing the changes should be included in the submittal. Requests to extend the dates allowing the
existing modular offices may be needed. Ted Shepard is the project planner for the HP site. Because of the size of
the site, a separate permit for the erosion control measures was issued by the City of Fort Collins. Mr. Barnes will
find out whether the permit will require an amendment to allow the changes.
Felix Lee discussed building permit and code issues. The project has a "revocable permit" pending the City Council
hearing regarding rebates on the development fees which is scheduled for next week. All City approvals are in
place for the unlimited building permit. It is unclear whether the fee rebate program is available to a project that
will not result in immediate jobs. Mr. Bob Shefler of Hewlett-Packard has been working directly with the City's
finance administrator Alan Krcmarik on the fee payments and will continue to do so. Mr. Lee outlined the building
code language describing expiration of building permits. The building code states: "Every permit issued by the
building official under the provisions of this code shall expire by limitation and become null and void if the building
or work authorized by such permit is not commenced within 180 days from the date of such permit, or if the
building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for
a period of 180 days. Before such work can be recommenced, a new permit shall be first obtained to do so, and the
fee therefor shall be one half the amount required for a new permit for such work, provided no changes have been
made or will be made in the original plans and specifications for such work, and provided further that such
suspension or abandonment has not exceeded one year. In order to renew action on a permit after expiration, the
permittee shall pay a new full permit fee." These statements apply to the building permit fees only not development
or utility fees. It was suggested that the permit be taken out as a core and shell permit and finalized. A separate
tenant fmish permit could be issued in the future for completion of the work. Mr. Wolley stated that the work on the
exterior would probably be finished in February of 1999.
During the last 15 minutes of the meeting, representatives from Hewlett-Packard Company's real estate division and
the company's insurer Factory Mutual were present.
