Re: Lots 1 and 2, Preston -Kelly 2nd Subdivision to the City of Fort Collins, Colorado
(the "Property")
Per your request, this letter will confirm and acknowledge the undersigneds'
ongoing obligation to manage existing off -site and on -site storm water flows through the
Property. Such water flows generally move from west to east across the Property.
Currently, there exist on the Property a large swale across the northerly portion of the
Property and detention ponds that serve such purposes.
In developing the Property in the future, the undersigned agree to deal with such
storm water flows in a manner so as not to prevent or diminish such flows from passing
through the Property. The exact location and method for dealing with the storm water
flows will be determined by the undersigned in their collective reasonable judgment.
