Re: 3006 Rockborough Ct Replat
Description of project: This is a request to replat three existing lots located at 3006
Rockborough Ct, 2937 Eindborough Dr, and 3001 Eindborough Dr (parcel #8730210049;
8730210060; 8730210059). The proposal is to change the rear lot lines of the three
parcels to enlarge the lot for 3006 Rockborough Ct to 11,300 sf. All three parcels are
owned by the same party. Access is taken from Rockborough Ct directly to the southeast
and Eindborough Dr directly to the east. The property is within the Low Density Residential
(RL) zone district and is subject to a Basic Development Review.

comments offered informally by staff during the Conceptual Review will assist you in preparing
the detailed components of the project application. Modifications and additions to these comments

7. LUC 2.211 Lapse, Rounds of Review: Applicants, within one hundred eighty (180) days of
receipt of written comments and notice to respond from the City on any application submittal (or
subsequent revision to a submittal) of an application for approval of a development plan, shall
file such additional or revised submittal documents as are necessary to address such
comments from the City. If the additional submittal information or revised submittal is not filed
within said period of time, the development application shall automatically lapse and become null and void.

This is an estimate of the initial fees to begin the development review process based on
your Conceptual Review Application. As noted in the comments, there are additional fees
required by other departments, and additional fees at the time of building permit. The City
of Fort Collins fee schedule is subject to change ‑ please confirm these estimates before

9. Submittals are accepted any day of the week, with Wednesday at noon being the cut‑off for
routing the same week. Upon initial submittal, your project will be subject to a
completeness review. Staff has until noon that Friday to determine if the project contains all
required checklist items and is sufficient for a round of review. If complete, a formal Letter
of Acceptance will be emailed to you and the project would be officially routed with a
three‑week round of review, followed by a formal meeting.

least 24 hours in advance. Applications and plans are submitted electronically with initial fees.
Pre‑submittal meetings can be beneficial to ensure you have everything for a complete

11. Temporary Service Changes ‑ City of Fort Collins Development Review
In order to continue providing thorough reviews and giving every project the attention it
deserves, the City of Fort Collins is implementing temporary changes in how we serve our
development customers. As you may be aware, we are experiencing staff shortages in a
number of key departments, which has begun to impact the quality and timeliness of our
reviews. We recognize that development and construction play a critical role in our
community’s vibrancy and economic recovery, and we have been exploring options for
mitigating impacts to our customers. As a result, we will be making some temporary service changes.
Beginning Monday May 10th one additional week of review time will be added to all 1st and
2nd round submittals (increase from 3 weeks to 4 weeks).

1. How will the existing 14 foot utility easement that runs along the rear property line be
preserved or modified? If project also wishes to relocate the easement, additional
coordination will be needed with the utility provider to ensure their needs are being met. If
no modifications are proposed, how will utility access be preserved for both 3001 and 2937 Eindborough?
The existing easements will not be modified. An additional 7-foot utility easement will be dedicated to access 3001 Eindborough. See proposed Replat.
2. With the replat, an improvement location certificate will be required to ensure that all zone
district setbacks are being met. For this site, the subdivision has more stringent setbacks
than what is required by City code and must demonstrate a 30' front yard setback, 7 foot
side‑yard, and 15 rear‑yard setback. More information can be found by visiting

Compliance with existing setbacks will be met with the possible exception of the SW corner of Lot 60A. The proposed property line on this side is at an angle to the existing house.
The proposed Replat considers this angled portion a revision of the side property line. If the setback requirement at this location is required to meet the SIDE setback of 7 feet,
compliance is met. However, the setback at this angled property line is short of the REAR setback requirements of 15 feet. If it is determined to the REAR setback dimensions must be
met, the applicant would like to request a 3-foot variance from this requirement.
3. The lot size and floor area requirement seems to meet standards. Please calculate the
floor area of each building based on the following definition, Floor area shall mean the
gross floor area of a building as measured along the outside walls of the building and
including each floor level, but not including open balconies, the first seven hundred twenty
(720) square feet of garages or other enclosed automobile parking areas.
2937 Eindborough is 2,450 sf. 3001 Eindborough is 1,800 sf. 3006 Rockborough Ct. is 2,000 sf. Proposed lot sizes as indicated on the ILC meet requirements.

1. It appears that the only intent of the proposal is to replat to change the property boundary
of three existing parcels with no new lot(s) created. Under the premise that there is no
development associated with this, it appears a replat would be all that's required. It
should be noted however that there appears to be an existing utility easement along the
rear of the lots which may likely have existing utility infrastructure. The 3006
Rockborough property would potentially have existing utilities in an an existing easement
that would now bisect the property. The utility providers may have concerns with the
proposal as a result. Additionally the applicant should be aware that the construction of
buildings or other appurtenances on top of potential utilities in a utility easement may not be permitted.
No new construction is proposed at this time. All utilities have been contacted. The existing easements will not be modified. An additional 7-foot utility easement will be dedicated
to access 3001 Eindborough. See proposed Replat.

1. No Comment from Erosion Control. Based upon the submitted Planning Materials it has
been determined that this project; will disturb less than 10,000 sq. ft., is not proposed to
be in a sensitive area, has no steep slopes (greater than 3H:1V) within or adjacent to
the project, and is not part of a larger common development that will or is under
construction. Therefore, no Erosion Control Material submittal is needed. If this project
substantially changes in size or design where the above criteria now apply, erosion
control materials should be submitted. Though the project at this time requires no
erosion control material submittal, the project still must be swept and maintained to
prevent dirt, saw cuttings, concrete wash, trash debris, landscape materials and other
pollutants from the potential of leaving the site and entering the storm sewer at all times
during the project in accordance with City Code 26‑498. If complaint driven or site
observation of the project seem not to prevent the pollutant discharge the City may
require the project to install erosion and sediment control measures. Nearby inlets that
may be impacted by the pollutants, in particular dirt, should be protected as a good
preventative practice and individual lots should be protected from material escaping
onto the sidewalk. If at building permit issuance any issues arise please email
erosion@fcgov.com to help facilitate getting these permits signed off.
