SUBJECT:
Resolution 88-137 Authorizing a Waiver From the Public Street Capacity
Requirement to Construct Off -site Street Improvements as Required by the
Intergovernmental Agreement between the City of Fort Collins and Larimer
County.
RECOMMENDATION:
Staff recommends approval of this Resolution.
FINANCIAL IMPACT:
The financial impact of waiving the requirement to construct or fully
improve off -site streets to the standards indicated on the City's Master
Street Plan will be mitigated by charging a fee of $700 per single-family
home to be collected by Larimer County at the time of building permit
issuance.
EXECUTIVE SUMMARY:
The request pertains to the Saddleback Preliminary Subdivision, Phases II,
III, and IV, located on the west side of North Taft Hill Road approximately
one-half mile north of Vine Drive.
Saddleback Preliminary Subdivision, Phases II, III, and IV, consists of 71
lots on 35.42 acres. The parcel is located west of Saddleback Phase I,
which consists of 27 lots on 14.4 acres and was approved in Larimer County
in 1977.
The request for a Waiver from the Public Street Capacity is justified under
the terms of the Intergovernmental Agreement. The Saddleback Preliminary
Subdivision qualifies as an "in -fill" development. A major goal of many of
the policies of the Urban Growth Area Agreement is to encourage "in -fill"
development proposals versus proposals in essentially undeveloped portions
of the U.G.A.
The Waiver request is subject to the collection of $700 per single-family
home to be collected by Larimer County at the time of building permit
issuance. This fee of $700 is fifty dollars less than the fee stipulated
by the Planning and Zoning Board in its approval of August 22, 1988. The
fee of $700 is based on further clarification with the Larimer County

Planning Department. The Waiver request is also subject to the
improvements stipulated in the Traffic Impact Analysis submitted to Larimer
County as part of the requirements for a preliminary plat.
The Waiver request was recommended for approval by the Planning and Zoning
Board, by unanimous vote on its Consent Calendar, at its regular meeting of
August 22, 1988.
Staff believes that granting the request for a Waiver from the Public
Street Capacity will not jeopardize the public health, safety, and welfare
and that the intent and purpose of the Urban Growth Area Agreement will be
maintained.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING A WAIVER OF THE PUBLIC STREET
CAPACITY IMPROVEMENTS
AS REQUIRED BY THE INTERGOVERNMENTAL AGREEMENT
BETWEEN THE CITY OF FORT COLLINS AND LARIMER COUNTY
FOR THE SADDLEBACK PRELIMINARY SUBDIVISION,
PHASES II, III, AND IV
WHEREAS, the Council of the City of Fort Collins/haseen petitioned
to waive the Public Street Capacity requirements aslated in the
Intergovernmental Agreement between the City of Forts and Larimer
County for the Saddleback Preliminary Subdivision, Pha, III, and IV;
and
WHEREAS, the Saddleback Preliminary Subdivisio , Phases II, III, and
IV is located within the Urban Growth Area and wo d be serviced by basic
infrastructure provided by the City of Fort Colli Department of Water and
Sewer and the Public Service Company of Colorado• and
WHEREAS, Saddleback Preliminary Subdivi on, Phases II, III, and IV
has been defined as "in -fill" development ccording to the definition of
the Intergovernmental Agreement and, they fore, eligible for the Waiver
From the Public Street Capacity requireme s; and
WHEREAS, the petitioners have sub itted the appropriate documentation
supporting the Waiver request, and thi documentation has been reviewed and
found acceptable to the Director of velopment Services.
NOW, THEREFORE, BE IT RESOL D BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the request for a fiver From the Public Street Capacity for
Saddleback Preliminary Subdivi ion, Phases II, III, and IV is hereby
approved subject to the following conditions:
1. A Waiver Fee of /S700 per single family home be collected by
Larimer County at/the time of building permit issuance.
2. The sight dis nce constraint caused by the hill on North Taft
Hill Road wil be addressed with additional signage.
3. A northboo d left -turn auxiliary lane will be required on North
Taft Hill/ Road at Stonecrest Drive.
4. A nor bound right turn auxiliary lane will be required on North
Over and Trail at Wakonda Drive.
5.5 additional southbound right -turn auxiliary land will be
/required on North Taft Hill Road at Stonecrest Drive.
