Murdoff 2208 Stonecrest Drive Fort Collins, Colorado 80521 OWNER: Same PROJECT PLANNER: Joe Frank PROJECT DESCRIPTION: Request for Out -of -City utility service for a 71-unit single family subdivision, located on the west side of Taft Hill Road and approxi- mately 1/2 mile north of Vine Drive. RECOMMENDATION: Staff recommends approval of the Out -of -City utility ser- vice request on the condition that the Water Board and the Director of Water Utilities approve the request, the property be included within the Municipal Sub- district of the Northern Colorado Water Conservancy District, and the property owner signs the standard Out -of -City Utility Service Agreements. These agree- ments shall include a clause binding the property owners to annex their properties at such time that they meet the requirements for annexation. P & Z Meeting - August 22, 1988 Page 2 COMMENTS: 1. Background: The applicant and property owner, Gordon A. Murdoff, has submitted a written request for Out -of -City utility service (see attached letter of July 8, 1988) for Phases II, II1, and IV of the Saddleback Subdivision, located on the west side of Taft Hill Road and approximately 1/2 mile north of Vine Drive. The property is currently undeveloped, but the owner plans to develop 71 single family lots on the 35.42 acre site. Out -of -City utility service requests no longer require approval by City Council. Applications are submitted. to the City's Water Utilities Department. The applica- tion is reviewed by the Water Board for technical service issues and the Planning and Zoning Board for land use issues. The Water Board will review the applica- tion at their meeting of August 26, 1988. In addition, since the passage on second reading of City Ordinance No. 86, 1988 at the July 5, 1988 council meeting, it is necessary for anyone requesting Out -of -City service to petition the Northern Colo- rado Water Conservancy District (NCWCD) for inclusion into their Municipal Sub- district. The applicant has submitted his request and is waiting for NCWCD action. RECOMMENDATION: Staff recommends approval of the Out -of -City utility service request on the fol- lowing conditions: 1. That the Water Board and the Director of Water Utilities approve the request at their meeting of August 26, 1988. 2. The property be included into the Municipal Subdistrict of the Northern Colo- rado Water Conservancy District. 3. Subdistrict of the Northern Colorado Water Conservancy District, and the prop- erty owner signs the standard Out -of -City Utility Service Agreements. 4.
