Since you took the time to review this proposal, the County staff would like to make you aware of our position on this matter. As you know, the preliminary plat and waiver of the off -site street capacity requirements were considered at the time that the original Intergovernmental Agreement for the Fort Collins Urban Growth Area was about to expire. Legal counsel for the County was of the opinion that the waiver request would be decided by the Board of County Commissioners pursuant to the provisions of the new Intergovernmental Agreement. The County Commissioners were aware of the action of City Council but accepted this information as a recommendation and approved the waiver as proposed. Of course the preliminary plat was also conditionally approved. We are also confronted with the vested rights issue in this case. The preliminary plat vests, pursuant to state statute, under County regulations, therefore we do not have an opportunity to change conditions of approval at this time. If the applicant proposes any significant changes to the preliminary plat or if the vesting runs out, we can impose any appropriate new conditions at that time. Given the circumstances, the County staff will recommend to the Board of County Commissioners that they approve the proposed one-year time extension with the same conditions that were originally imposed, including the approval of the waiver of the off -site street capacity requirements.
