one-year extension of the approval of the Preliminary Plat
of Saddleback Subdivision, Phases II, III & IV. Original
approval of the project was granted last year at this time.
I am enclosing a check in the amount of $220.00 for
the gees associated with this request, as per our phone
conversation earlier this week.

Findings and Resolution
Concerning the Preliminary Plat of Phases I1, III do IV of
Saddleback Subdivision
The application for the Saddleback Subdivision, Phase II, III and IV upon the
property described on Exhibit "A" attached hereto has heretofore been filed with the
Board of County Commissioners of the County of Larimer.
The Larimer County Planning Commission on July 20, 1988, reviewed the proposed
subdivision and having duly considered the same recommended that it be approved
subject to certain conditions, which conditions have either been satisfied or are
incorporated herein.
On August 22, 1988, in the County Board Hearing Room of the Larimer County
Courthouse, Fort Collins, Colorado, the Board of County Commissioners of the County of
Larimer conducted a public hearing on said preliminary plat of this subdivision. The

Board of County Commissioners having heard the testimony and evidence adduced at said
hearing, and having considered and carefully weighed the same, and having received the
recommendations of the County Planning Staff, now makes the following findings:
1. Notice of this hearing upon the preliminary plat of the proposed subdivision
has been duly advertised in a local newspaper of general circulation as required by law.
2. Written notice of this hearing has been delivered or mailed, first class,
postage prepaid, to adjoining landowners of the proposed subdivision.
3. The County Planning Staff and County Engineer have made certain
recommendations and comments concerning this subdivision which recommendations and
comments are contained in the agenda for the August 22, 1988 meeting of the Board of
County Commissioners and are filed with the record of this proposal.

4. The proposed preliminary plat of Saddleback Subdivision, Phase II, III & IV,
is consistent with the Larimer County Comprehensive Plan and with the land use policies
established by the Intergovernmental Agreement for the Fort Collins Urban Growth
Area.
5. Rezoning the site from R-Residential to R-1 Residential is consistent with
the land use policies established by the Intergovernmental Agreement for the Fort
Collins Urban Growth Area.
6. Approval of the preliminary plat for Saddleback Subdivision, Phases II, III &
IV as conditioned below, shall not result in any signficant negative impacts on utility
services, transportation facilities, surrounding properties, or the natural environment.
7. To approve this subdivision as recommended by the County Planning
Commission and upon the conditions hereinafter set forth would thus promote the
harmonious development of the area with particular respect to its topography, would be
in the best iAterest of the people of Larimer County, would increase the tax base, and
would promote the convenience, prosperity and general welfare of the immediate
inhabitants of the area with particular respect to natural areas, schools, parks and open
spaces, floodways, street layouts and access ways, prevention of pollution and geologic
hazards, and fire and police protection.
RESOLUTION
WHEREAS, the Board of County Commissioners has made its findings upon the
application for approval of the preliminary plat of this subdivision and upon the
resolution of the Larimer County Planning Commission, which findings precede this
resolution, and by reference are incorporated herein and made a part hereof; and
WHEREAS, the Board of County Commissioners has carefully considered the

application, resolution, evidence and testimony presented to it, and has given the same
such weight as it in its discretion deems proper, and is now fully advised in the premises;
NOW, THEREFORE, BE IT RESOLVED that the preliminary plat of the Saddleback
Subdivision as proposed on the property described on Exhibit "A" be and the same hereby
is approved subject to the conditions hereinafter set forth.
Approval of the rezoning of the property described on Exhibit "A" from R-
Residential to R-1 Residential.
Approval of the proposed rural street standards, provided that appropriate
edge protection is constructed.
Approval of the waiver of the off -site street capacity requirements of the
Urban Growth Area Agreement.
The following conditions shall attach to the approval of the preliminary
plat of Saddleback Subdivision, Phases, II, III & IV:
1. .All final plats shall be completed in strict conformance with the
requirements of the Larimer County Subdivision Resolution and with the conditionally
approved preliminary plat.
2. The two fire hydrants noted in the letter from the Poudre Fire Authority
dated June 9, 1988, shall be relocated on the final utility plans.
3. Prior to any final plat application the applicant shall finalize an Out of
City Utility Service Agreement with the City of Fort Collins.
4. The existing water line between Lots 16 and 17, Block 2, shall be addressed
in the final utility plans if it is to be abandoned or an easement shall be include on the
final plat if the water line is to remain.
5. The width of the easement between Lots 7, 8, 13 and 14, Block 3, shall be

shown on the final plat.
6. Minimum front setbacks shall be shown on all reversed corner lots on the
final plat.
7. The homeowners association documents submitted with any final plat shall
include specific information concerning the rights and responsibilities of the lot owners
with respect to the drainage facilities. Also included shall be a specific time table for
deeding these facilities to the homeowners.
8. The following notes shall be placed on all final plats:
a. Engineered footing and foundation plans shall be required for any
construction on this site.
b. Larimer County Park Fees for the Fort Collins Urban Growth Area
shall be paid when building permits are issued for each single family dwelling on this site.
C. The street improvement fee shall be paid when building permits are
issued for eaeh single family dwelling in this project.
d. After each residential structure is enclosed, but prior to the
issuance of a Certificate of Occupancy, air samples shall be collected and analyzed by a
qualified laboratory to determine if radon gas is present in the structure.
9. This preliminary plat constitutes a site specific development plan, the
approval of which triggers a vested property right pursuant to state and local law. If this
approval is conditional, failure to abide by the terms and conditions shall result in a
forfeiture of vested property rights.
10. Lots 17, 18 and 19 of Block 2 shall be redesigned to make three lots into
two lots.
11. Lots 1, 2 and 3 of Block 4 are to be made into two lots rather than three

lots.
12. Wakonda Drive will not be constructed as a through street at this time but
public right-of-way shall be dedicated for future connection, and the design at this time
shall be for emergency access only, subject to the approval of the Poudre Fire Authority
and the County Engineer.
13. There shall be a note on the plat that the streets are not designed to
County geometric standards and will not be County -maintained.
This constitutes a site specific development plan, the approval of which triggers a
vested property right pursuant to state and local law. If this approval is conditional,
failure to abide by the terms and conditions will result in a forfeiture of vested property
rights. This site specific development plan shall be deemed approved upon the date on
which this written Findings and Resolution is signed by the Chairman, or Chairman
Pro-Tem, of the Board of County Commissioners. The Director of Planning shall cause a
notice to be published in a newspaper of general circulation in Larimer County advising
the general public of this site specific development plan approval and creation of a
vested property right, such publication to occur no later than 14 days after this written
Findings and Resolution is signed by the Chairman, or Chairman Pro-Tem, of the Board
of County Commissioners.
