Generally, the mitigation plan and notes seem adequate for Preliminary Plan
stage. They can be clarified and strengthened with the following:
1. The area which will be disturbed by the Fossil Creek Parkway reallignment
should have a note like the ones on the Pace site: "seed slopes to limit of area
disturbed by construction...". Also, if some trees and shrubs are
disturbed by construction of the reallignment, replacements should be included
in the revegetation plans.
2. Expectations may be clarified by requesting a note stating the proposed
course of action if acceptable mitigation is found not to work at this
location. I should add, with slight reservation, that I believe the proposed
mitigation activities will be viable, with appropriate design at the Final Plan
Stage.
3. The stream which runs through the lowland portion of the site should be used
as an amenity in future phases. Redirecting the flow through the mitigation area
is desirable to provide additional moisture for plantings.
. The trees
have supported redtail hawk
and possibly
owl nests in the past. If
tree removal
is timed to coincide with
the nesting season,
special care should
be taken to
avoid nest disturbance, or
to have the Division
of Wildlife relocate
the birds. A
note to this effect will need to be put
on the final plan.
