Temporary Service Changes - City of Fort Collins Development Review
In order to continue providing thorough reviews and giving every project the
attention it deserves, the City of Fort Collins is implementing temporary
changes in how we serve our development customers. As you may be aware,
we are experiencing staff shortages in a number of key departments, which has
begun to impact the timeliness of our reviews. We recognize that development
and construction play a critical role in our community’s vibrancy and economic
recovery, and we have been exploring options for mitigating impacts to our
customers. As a result, we will be making some temporary service changes.
Beginning Monday May 10th one additional week of review time will be added
to all 1st and 2nd round submittals (increase from 3 weeks to 4 weeks).

LUC 2.211 Lapse, Term of Vested Right: Within a maximum of three (3) years
following the approval of a final plan or other site specific development plan, the
applicant must undertake, install and complete all engineering improvements
(water, sewer, streets, curb, gutter, street lights, fire hydrants and storm
drainage) in accordance with city codes, rules and regulations. The period of
time shall constitute the "term of the vested property right." Failure to undertake
and complete such engineering improvements within the term of the vested
property right shall cause a forfeiture of the vested property right and shall
require resubmission of all materials and reapproval of the same to be
processed as required by this Code. All dedications as contained on the final
plat shall remain valid unless vacated in accordance with law.

both storm lines on the east and west of Snead Drive, along with providing

Based upon the area of disturbance State permits for stormwater will be
required since the site is over an acre and should be obtained prior to
commencement of Construction Activities on the site.

The City Manager’s development review fee schedule under City Code 7.5-2
was updated to include fees for Erosion Control and Stormwater Inspections.
As of January 1st, 2021, these fees will be collected on all projects for such inspections.
The Erosion Control fees are based on; the number of lots, the total site
disturbance, the estimated number of years the project will be active and the
Stormwater Inspection Fees are based on the number of LID/WQ Features that
are designed for on this project.
Based on the proposed site construction associated with this project we are
assuming 1 lot, 3.5 acres of disturbance, 1 years from demo through build out of
construction and an additional 3 years till full vegetative stabilization due to
seeding. Which results in an Erosion Control Inspection Fee estimate of
$1301.44.
Based on 2 detention basins, and 1 sand filter- underground treatment the
estimate of the Stormwater LID/WQ Inspection fee is $915.
Please note that as the plans and any subsequent review modifications of the
above-mentioned values change the fees may need to be modified. I have
provided a copy of the spreadsheet used to arrive at these estimates for you to
review.

- Upon further review, the City requires that riprap is 12-min (d50) minimum.
Please use Type M instead of Type L.
- The drainage report calculations show the riprap apron length should be 27.8
feet, but the plans show 21-ft (by measurement.) . Please extend riprap apron
to match calculated minimum length.

The calculations for riprap apron at the outlet assumed a tailwater depth of
4-feet. This seems high, please provide documentation for the tailwater depth
or revise to assume Yt = 0.4 x culvert rise.

Outlet scour protection for the outfall to Fossil Creek needs to be evaluated and
provided. This needs to be discussed in the drainage report and shown on the
Utility Plans. This was mentioned during PDP.

- It would also help to show the wetland linework on the Landscape Plans. It
appears there are wetlands within the TCE area and need further clarification of
work area and impacts.
- There are several trees that need to be adjusted to provide 10-ft min
separation from the storm drain lines. (see redlines)
Temp. Construction Access, wetland boundaries now shown. Trees have been eliminated in this area and ownership has elected
to use the Payment-in-Lieu options for these 7 required trees.

accepted before the CO can be issued. In addition, there is a required “During

these forms during the Development Construction Permit (DCP) meeting, just
prior to construction.

Based on the wetlands and trees documented by the environmental consultant
and city forestry staff near fossil creek, the boundary of the temporary
construction easement encompasses wetlands and additional trees. Please
verify that these resources will not be impacted and include an LOD on site,
landscape and utility plans where construction fencing must be installed to
protect wetlands. Also add a note that directs the contractor not to impact
existing wetlands or trees since construction will be occurring so close to

existing resources. Include tree protection around the trees being protected. If
wetlands will be impacted, please work with the Corps to adhere to federal
requirements and provide the City with a letter from the Corps that the project
adheres to federal wetland protection requirements.
JR Response: Addressed, the limit of disturbance was revised and a note to protect the existing trees and
wetland was added to the plans. Break away silt fence was already included on the plans, and adjusted to be outside of existing
wetlands.
10/18/2021: FOR APPROVAL: NEED MORE CLARITY
There seems to be potential impacts to wetlands and waters of the US (Fossil
Creek) from the storm outfall. Wetlands may be impacted which are regulated
by the Corps of Engineers. The City requires a letter from the Corps indicating
the project complies with federal regulations. Moreover, the ECS never
accounted for these offsite improvements that could impact resources.
Wetlands must be delineated and shown on plans to ensure protection during
construction.

Forestry would prefer payment in lieu for the 7 trees being proposed south of
Fossil Creek Pkwy. Due to the logistics of getting irrigation to them the trees
would not be set up for success if planted in that area. The payment in lieu is
$450 per tree which would then go into City Forestry's planting program.
Ownership agrees – Payment-in-lieu is the preferred option vs. providing temp. irrigation for the trees.
