Andrew Gingerich, Interim Deputy Director of Water Utilities, has written an email to serve as an LOI for concurrence to proceed with the design of a public sewer main crossing these 2 City owned parcels – which are maintained by Stormwater. This is in a manner more or less consistent with the design drawings attached to this email. It is common for LOIs to come in the form of an email. From the development review position, this LOI is sufficient to proceed to Hearing for this requirement (noting there are still other engineering requirements to be addressed before Hearing per the comment letter). For final approval at FDP an “alignment” diagram (City internal equivalent of an easement) will need to be drawn up and recorded. This is just like an easement, just for City purposes we don’t grant an easement to ourselves, but instead record an “alignment” (same thing different name). Based on this, do you have any questions for me? Do we need the meeting this afternoon? As we discussed in our meeting I am supportive of allowing the sewer to cross the stormwater property as shown on the plans. Since this will be a City owned sewer on City owned land it will not be an easement but instead would be a recorded alignment. With my authority as interim deputy director of Utilities please consider this email as my support and approval to allow the sewer to be built on this property. I intend that this will serve as letter of intent and allow this project to proceed to P&Z Board. 2 Let me know if you have any questions, Andrew S. The developer is requesting a “letter of intent” for crossing the City owned parcels highlighted below. These parcels are maintained by Stormwater. This LOI is a development review requirement before PnZ Hearing for all projects needing an offsite easement (or alignment) from other property owners. As we discussed today, an email from Andrew, Deputy Director Water Utilities Field Services, would be sufficient for my needs as the development reviewer. Please see the attached for the proposed Sanitary Sewer line running adjacent to Lake Canal and through the Canyon Concert Ballet Company’s parking lot. We already have buy in and signed LOI’s from both of those companies and are working with Matt Simpson through the details and believe this is the best path forward for a gravity fed line in lieu of utilizing a lift station.
