It is the City Attorney's opinion that since you, as the daughter, would not reside at 2607 Dunber but would hire a professional care provider, then your mother would not be "family" to any occupant in the home. Therefore, your mother would be a client and would have to be counted as such. This opinion would change, however, if it could be documented that your mother was an owner or part owner of the property. If your mother retained an owner- ship interest, then she would be allowed to live there with three other clients and receive care from the hired care provider. As you suggested, I have placed a call to Mr. Rutz to discuss this interpretation but my call has not been returned as of this writing. I would strongly urge that you or Mr. Rutz provide proof of your mother's ownership interest in 2607 Dunbar. This proof would then be forwarded to the Planning and Zoning Board and offered as evidence in the Special Review hearing for approval of the personal board and care group home for three elderly clients, plus your mother. I anticipate that your approval would be for three elderly clients with a special condition that the fourth client be restricted to being only your mother as she would have an ownership interest. The approval must be very clear that if your mother would no longer reside in the home, a new fourth client would not be allowed. Please keep in mind that on Monday, September 19, 1988, I need 10 blueprints of the site plan. One of these prints should be colored so when we take a slide it will show up on the screen. Also, please make a PMT (photographic mechanical transfer) reduction to 8 1/2 x 11 of the site plan. This reduction goes into the packet for the P & Z Board.
