Resolution 89- Finding Substantial Compliance and Initiating Annexation
Proceedings for the McClanahan First Annexation.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
The applicants and owners, Fred R. and Dorothy L. McClanahan, have
submitted a written petition requesting annexation of approximately 9.1
acres located west of S. College Avenue and south of Harmony Road.
The proposed Resolution makes a finding that the petition substantially
complies with the Municipal Annexation Act, determines that a hearing
should be established regarding the annexation, and directs that notice to
be given of the hearing. The hearing will be held at the time of first
reading of the annexation and zoning ordinances. Not less than thirty days
of prior notice is required by Colorado law.
The property is located within the Fort Collins Urban Growth Area.
According to policies and agreements between the City of Fort Collins and
Larimer County contained in the Intergovernmental Agreement for the Fort
Collins Urban Growth Area, the City will annex property in the UGA when the
property is eligible for annexation according to state law. The property
gains the required 1/6 contiguity to existing city limits from a common
boundaries with the Fairway Estates Business Annexation to the east and the
Mill 1st and 2nd Annexations to the south.
Planning and Zoning Board Recommendation:
The Planning and Zoning Board will conduct a public hearing on the request
for annexation and zoning at its regular monthly meeting on March 27, 1989,
and will make its recommendation at that time. The Board's recommendation
will be forwarded to the City Council in time for the public hearing and
first reading of the annexation and zoning ordinances.
RESOLUTION 89-
OF THE COUNCIL OF THE CITY OF FORT COLLINS
FINDING SUBSTANTIAL COMPLIANCE AND
INITIATING ANNEXATION PROCEEDINGS FOR THE
MCCLANAHAN FIRST ANNEXATION
WHEREAS, a written petition, together with four (4) prints of an
annexation map, was heretofore filed with the City Clerk requesting the
annexation of certain property to be known as the McClanahan First
Annexation; and
WHEREAS, the City Council desires to initiate annexation proceedings
in accordance with law.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the City Council hereby accepts the annexation
petition for the McClanahan First Annexation, more particularly described
as situate in the County of Larimer, State of Colorado, to wit:
A tract of land situate in the County of Larimer, State of
Colorado to -wit:
A tract of land located in the Northeast 1/4 of Section 2,
Township 6 North, Range 69 West of the Sixth P.M., County of
Larimer, State of Colorado being more particularly described as
follows: Considering the East line of said Section 2 as bearing
N 00°47'00" E and with all bearings contained herein relative
thereto: Commencing at the Southeast corner of said Section 2;
thence along said East line N 00°47'00" E 2681.70 feet; thence
N 88045'00" W 48.40 feet to the Point of Beginning, said point
being on the West right-of-way line of U.S. Highway No. 287 and
also on the West line of Fairway Estates Business Annexation;
thence along said West line N 00°48'35" E 433.99 feet; thence
departing from said West line N 88°45'00" W 913.46 feet to the
East right-of-way line of the Burlington Norther Railroad, said
right-of-way line being 100.00 feet from the centerline of the
said railroad; thence S 00°53'00" W 433.98 feet along the said
East right-of-way line to a point on the North line of Mill
Second Annexation, thence along said North line S 88°45'00" E
694.02 feet to the Northwest corner of Mill First Annexation;
thence along the North line of said Mill First Annexation 220.00
feet to the Point of Beginning.
The above -described tract contains 9.1034 acres more or less and
is subject to all easements, restrictions and rights -of -way now
on record or existing.
The above -described tract of land was complied from existing
plats and legal descriptions. No field survey was performed.
Section 2. That the City Council hereby finds and determines that the
annexation petition and accompanying map are in substantial compliance with
the Municipal Annexation Act, and desires to initiate annexation
proceedings in accordance with law.
Section 3. That the Notice attached hereto be adopted as a part of
this Resolution. Said Notice establishes the date, time and place when a
public hearing will be held regarding the passage of an annexation
ordinance pertaining to the above described property. The City Clerk is
directed to publish a copy of this Resolution and said Notice as provided
in the Municipal Annexation Act.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 21st day of February, A.D. 1989.

NOTICE
TO ALL PERSONS INTERESTED:
PLEASE TAKE NOTICE that the City Council of the City of Fort Collins
has adopted a Resolution initiating annexation proceedings for the
McClanahan First Annexation, said Annexation being more particularly
described in said Resolution, a copy of which precedes this Notice.
That, on April 4, 1989, at the hour of 6:30 p.m., or as soon
thereafter as the matter may come on for hearing in the Council Chambers in
the City Hall, 300 Laporte Avenue, Fort Collins, Colorado, the Fort Collins
City Council will hold a public hearing upon the annexation petition for
the purpose of finding and determining whether the property proposed to be
annexed meets the applicable requirements of Colorado law and is considered
eligible for annexation. At such hearing, any persons may appear and
present such evidence as they may desire.
