SUBJECT:
Hearing and First Reading of Ordinance No. 101, 1991, Rezoning 32.2 Acres of the
Horsetooth Business Park PUD From R-H, Conditional High Density Residential to
I-P, Industrial Park.
RECOMMENDATION:
Staff recommends adoption of the Ordinance.
EXECUTIVE SUMMARY:
This is a request to rezone 32.2 acres, known as the Horsetooth Business Park
PUD from R-H, conditional High Density Residential to I-P, Industrial Park. The
site is located at the southwest corner of Horsetooth and Timberline Road. The
Horsetooth Business Park PUD includes the new Public Service Company
administration offices and service yard, as well as an approved Master Plan for
industrial and business service uses on the remainder of the 32-acre site.
The petitioner for this rezoning is the W. W. Reynolds Companies, on behalf of
the property owner, Timberline Partnership.
This site has been zoned High Density Residential since the property was annexed
in 1977. A condition that the uses be limited to non-residential uses was
attached to the zoning in 1979. In 1982, the site was rezoned to R-H with the
condition that the site be developed through the PUD process. Since that time,
several PUD master plans and phase plans for industrial and commercial uses have
been approved for this site. The most recent, Horsetooth Business Park PUD
Master Plan and the preliminary and final plans for the Public Service Company
facility, were approved in April of 1991.
The requested rezoning is I-P, Industrial Park. The Industrial Park designation
is for light industrial park areas containing controlled industrial uses in
proximity to areas zoned for residential use and along arterial streets. All
land uses permitted in the I-P Zone require approval by the Director of Planning,
via an administrative site plan review.
The proposed rezoning would bring the zoning into conformance with the approved
Horsetooth Business Park PUD Master Plan and the type of uses planned and
approved for the site. The I-P zoning would also be consistent with existing
zoning to the north and south of this site.

The proposed rezoning is in conformance with the City's Land Use Policies Plan
and is consistent with surrounding zoning.
RECOMMENDATION:
The Planning and Zoning Board voted unanimously to recommend approval of this
rezoning on the consent agenda at the Board's regular meeting held on June 24,
1991.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING THE ZONING DISTRICT MAP OF THE
CITY OF FORT COLLINS, BY CHANGING
THE ZONING CLASSIFICATION FOR
THAT CERTAIN PROPERTY KNOWN AS THE
HORSETOOTH BUSINESS PARK REZONING
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1. That the Zoning District Map adopted by Chapter 29 of the Code
of the City of Fort Collins be, and the same hereby is, amended by changing the
zoning classification from "R-H," High Density Residential Zoning District, to
"I-P," Industrial Park Zoning District, for the following described property in
the City known as the Horsetooth Business Park Rezoning:
A tract of land situated in the Northeast 1/4 of Section 31,
Township 7 North, Range 68 West of the Sixth P.M., Fort Collins,
Colorado, which, considering the North line of said Northeast 1/4
as bearing N 89*57' E and with all bearings contained herein
relative thereto, is contained within the boundary lines which begin
at the Northeast corner of said Section 31 and run thence South
1329.85 feet along the East line of said Northeast 1/4; thence N
89°57'30" W, 1056.87 feet to a point on the Easterly right-of-way
line of the Union Pacific Railroad; thence along said right-of-way
line, N 00*01' E, 1328.16 feet to a point on the North line of said
• Northeast 1/4; thence N 89*57' E, 1056.48 feet to the point of
beginning, containing 32.2388 acres, more or less.
Section 2. The City Engineer is hereby authorized and directed to amend
said Zoning District Map in accordance with this Ordinance.
Introduced, considered favorably on first reading, and ordered published
this 20th day of August, A.D. 1991, and to be presented for final passage on the
3rd day of September, A.D. 1991.
