Resolution 89- 49 Finding Substantial Compliance and Initiating Annexation
Proceedings for Lemay Avenue Second Annexation.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
The City of Fort Collins is the applicant and owner of the property to be
annexed, which is 6.2 acres of Lemay Avenue right-of-way, located between
Mulberry Street and Lincoln Avenue.
The proposed Resolution makes a finding that the proposed annexation
substantially complies with the Municipal Annexation Act, determines that a
hearing should be established regarding the annexation, and directs that
notice be given of the hearing. The hearing will be held at the time of
first reading of the annexation and zoning ordinances. Not less than
thirty days of prior notice is required by Colorado Law.
The property is located within the Fort Collins Urban Growth Area.
According to policies and agreements between the City of Fort Collins and
Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT
COLLINS URBAN GROWTH AREA, the City will annex property in the UGA when the
property is eligible for annexation according to State law. The property
gains the required 1/6 contiguity to existing city limits from a common
boundary with the Second Fisher-Lemay Annexation to the east and the
Northeast Consolidated Annexation to the northwest.
Planning and Zoning Board Recommendation:
The Planning and Zoning Board, at its regular monthly meeting of January
23, 1989, voted 7-0 to recommend approval of the annexation and requested
zoning, as part of the Board's consent agenda.

RESOLUTION 89-49
OF THE COUNCIL OF THE CITY OF FORT COLLINS
FINDING SUBSTANTIAL COMPLIANCE AND
INITIATING ANNEXATION PROCEEDINGS FOR THE
LEMAY AVENUE SECOND ANNEXATION
WHEREAS, the City Council has determined that it is in the best
interest of the City that the City annex certain City -owned property as
hereafter described, to be known as the Lemay Avenue Second Annexation; and
WHEREAS, the City Council desires to initiate annexation proceedings
in accordance with law.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the City Council intends to annex the following
described property, to be known as the Lemay Avenue Second Annexation, more
particularly described as situate in the County of Larimer, State of
Colorado, to wit:
A tract of land situate in the West Half of Section 7 and the
Northwest Quarter of Section 18, Township 7 North, Range 68 West,
and the Southeast Quarter of Section 12, Township 7 North, Range
69 West of the 6th P.M., County of Larimer, State of Colorado,
which considering the North line of the Northwest Quarter of said
Section 18 as bearing N 89°04'47" E and with all bearings
contained herein relative thereto, is contained within the
boundary lines which begin at the Northwest corner of said
Section 18 and run thence N 89°04'47" E 209.33 feet to the true
point of beginning; thence N O1°07'31" W 71.42 feet; thence
S 89056'13" E 20.00 feet; thence N 01°37'53" E 1745.32 feet;
thence along the arc of a 930.93 foot radius curve to the left a
distance of 417.54 feet, the long chord of which bears
N 11°13'05" W 414.05 feet; thence N 24°04'02" W 333.38 feet;
thence along the arc of a 930.93 foot radius curve to the left a
distance of 65.02 feet, the long chord of which bears
N 26"13'30" W 65.01 feet to a point on the South right-of-way
line of E. Lincoln Avenue; thence S 88"31'49" W 43.57 feet along
the South right-of-way line of Lincoln Avenue; thence
N 00017'00" E 40.02 feet to the North line of the Southeast
quarter of Section 12; thence N 88°31'49" E 30.01 feet to the
East quarter corner of Section 12; thence N 88°31'49" E 30.01
feet; thence N 00°17'00" E 210.02 feet; thence S 14°39'06" E
174.52 feet to a point on the North right-of-way line of E.
Lincoln Avenue; thence N 88°31'49" E 60.12 feet along the North

80.04 feet; thence along the arc of a 1040.93 foot radius curve
to the right a distance of 18.25 feet, the long chord of which
bears S 24°42'32" E 18.25 feet; thence S 65055'58" W 10.00 feet;
thence S 24°04'02" E 333.38 feet; thence along the arc of a
1030.93 foot radius curve to the right a distance of 462.40 feet,
the long chord of which bears S 11°13'05" E 458.53 feet; thence
S 01°37'53" W 924.77 feet to the Northwest corner of the Second
Fisher-Lemay Avenue Annexation; thence S 01°37'53" W 817.81 feet;
thence S 01°08'12" E 250.01 feet; thence N 89657'41" W 120.06
feet; thence N 01°07'31" W 178.63 feet to the point of beginning.
Containing 6.9087 acres.
Section 2. That the City Council hereby initiates annexation
proceedings for the above described property.
Section 3. That the Notice attached hereto be adopted as a part of
this Resolution. Said Notice establishes the date, time and place when a
public hearing will be held regarding the passage of an annexation
ordinance pertaining to the above described property. The City Clerk is
directed to publish a copy of this Resolution and said Notice as provided
in the Municipal Annexation Act.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 21st day of February, A.D. 1989.
