RECOMMENDATION:
Staff recommends adoption of these items.
EXECUTIVE SUMMARY:
A. Hearing to Make Findings and Determinations Concerning the Orchard
Annexation.
B. Resolution 89-8 Setting Forth Findings of Fact and Determinations
Regarding the Orchard Annexation.
C. Second Reading of Ordinance No. 166, 1988, Annexing Approximately 6.08
Acres Known as Orchard Annexation.
D. Second Reading of Ordinance No. 167, 1988, Zoning Approximately 6.08
Acres Known as Orchard Annexation, into the R-L-P Low Density Planned
Residential District.

This Resolution sets forth findings and determinations that the area is
eligible for annexation pursuant to Colorado state law. Ordinance No. 166,
1988 and Ordinance No. 167, 1988, which were adopted 5-0 on First Reading
on December 6, annex and zone approximately 6.08 acres located south of
Harmony and east of Shields Street adjacent to the existing Clarendon Hills
development. The requested zoning is R-L-P Low Density Planned Residential
District.
Planning and Zoning Board Recommendation:
The Planning and Zoning Board, at its regular monthly meeting of December
19, 1988, voted 6-0 to recommend approval of the annexation and requested
zoning, as part of the Board's consent agenda.
RESOLUTION 89- 8
OF THE COUNCIL OF THE CITY OF FORT COLLINS
SETTING FORTH FINDINGS OF FACT AND DETERMINATIONS
REGARDING THE ORCHARD ANNEXATION
WHEREAS, annexation proceedings were heretofore initiated for property
to be known as the Orchard Annexation; and
WHEREAS, following Notice given as required by law, the City Council
has held a hearing on said Annexation.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That the City Council hereby finds that the petition for
annexation complies with the Municipal Annexation Act.
Section 2. That the City Council hereby finds that there is at least
one -sixth (1/6) contiguity between the City and the property seeking
annexation; that a community of interest exists between the property
proposed to be annexed and the City; that said property is urban or will be
urbanized in the near future; and that said property is integrated with or
is capable of being integrated with the City.
Section 3. That the City Council further determines that the
applicable parts of said Act have been met, that an election is not
required under said Act, and that there are no other terms and conditions
to be imposed upon said annexation.
Section 4. That the City Council further finds that notice was duly
given and a hearing was held regarding the annexation in accordance with
said Act.
Section 5. That the City Council concludes that the area proposed to
be annexed in the Orchard Annexation is eligible for annexation to the City
of Fort Collins and should be so annexed.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 17th day of January, A.D. 1989.

SORDINANCE NO.166 , 1988
OF THE COUNCIL OF THE CITY OF FORT COLLINS
ANNEXING PROPERTY KNOWN AS THE
ORCHARD ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
WHEREAS, Resolution 88-191, finding substantial compliance and
initiating annexation proceedings, has heretofore been adopted by the
Council of the City of Fort Collins; and
WHEREAS, the Council of the City of Fort Collins has found and
determined and does hereby find and determine that it is in the best
interests of the City of Fort Collins to annex said area to the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the following described property, to wit:
A tract of land located in the Southwest Quarter of Section 2,
Township 6 North, Range 69 West of the 6th Principal Meridian,
Larimer County, Colorado, being more particularly described as
follows:
Considering the South line of the Southwest Quarter of said
Section 2 as bearing North 88°26'52" East and with all bearings
contained herein relative thereto:
Beginning at the Southwest corner of said Southwest Quarter of
Section 2, thence along said South line of the Southwest Quarter
North 88°26'52" East 1310.22 feet to the West line of the East
One-half of said Southwest Quarter (said West line also being the
East line of Voc Tech/Smith Annexation to the City of Fort
Collins, Colorado); thence along said West line North 00'07'36"
East 1894.28 feet to a point on the North line of Applewood
Estates, Larimer County, Colorado; said point being the True
Point of Beginning; thence along the North line of said Applewood
Estates North 88"38'22" East 352.56 feet to the West line of that
tract of land described in Book 1631, Page 461 records of said
county; thence along said West line North 00°18'32" East 746.51
feet to a point on the North line of the East One-half of said
Southwest Quarter (said point also being on the Southerly line of
Voc Tech/Smith Annexation to the City of Fort Collins, Colorado);
thence along said North line South 89°28'53" West 354.85 feet to
the West line of the East One-half of said Southwest Quarter
(said West line also being the East line of Voc Tech/Smith
Annexation to the City of Fort Collins, Colorado); thence along
said West line South 00007'36" West 751.66 feet to the True Point
of Beginning. Said tract contains 6.08 acres, more or less, and
is subject to all easements and rights -of -way of record.

Section 2. That, in annexing said property to the City of Fort
Collins, the City of Fort Collins does not assume any obligation respecting
the construction of water mains, sewer lines, gas mains, electric service
lines, streets or any other services or utilities in connection with the
property hereby annexed except as may be provided by the ordinances of the
City of Fort Collins.
Section 3. That the City of Fort Collins hereby consents, pursuant to
Section 37-45-136(3.6), C.R.S., to the inclusion of said property into the
Municipal Subdistrict, Northern Colorado Water Conservancy District.

AMENDING CHAPTER 29 OF THE CODE OF THE
CITY OF FORT COLLINS, COMMONLY KNOWN AS THE
ZONING ORDINANCE, AND CLASSIFYING FOR ZONING PURPOSES
THE PROPERTY INCLUDED IN THE
ORCHARD ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows:
Section 1. That the Zoning District Map adopted by Chapter 29 of the
Code of the City of Fort Collins be, and the same hereby is, changed and
amended by including the property known as the Orchard Annexation to the
City of Fort Collins, Colorado, in the R-L-P Low Density Planned
Residential District:
A tract of land located in the Southwest Quarter of Section 2,

Larimer County, Colorado, being more particularly described as
