Staff recommends adoption of the Resolution and the Ordinances on
First Reading.
EXECUTIVE SUMMARY:
A. Resolution 88-191 Finding Substantial Compliance and Initiating
Annexation Proceedings for Orchard Annexation.
B. First Reading of Ordinance No. 166, 1988, Annexing Approximately
6.08 Acres Known as Orchard Annexation.
C. First Reading of Ordinance No. 167 , 1988, Zoning Approximately
6.08 Acres Known as Orchard Annexation, into the R-L-P Low Density
Planned Residential District.
This is a request to annex and zone approximately 6.08 acres located
south of Harmony and east of Shields Street adjacent to the existing
Clarendon Hills development. The requested zoning is R-L-P Low
Density Planned Residential District.

BACKGROUND:
The applicant, Gary Nordick, on behalf of the owner, Clarendon Hills
Association, has submitted a written petition requesting annexation of
approximately 6.08 acres located south of Harmony Road and east of
Shields Street adjacent to the existing Clarendon Hills development.
The property is located within the Fort Collins Urban Growth Area.
According to policies and agreements between the City of Fort Collins
and Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR
THE FORT COLLINS URBAN GROWTH AREA, the City will annex property in
the UGA when the property is eligible for annexation according to
State law. The property gains the required 1/6 contiguity to existing
city limits from a common boundary with the Voc Tech/Smith Annexation
to the north and west.
The R-L-P Low Density Planned Residential District designation is for
areas planned as a unit to provide variation in use, density and
building placement. The proposed master plan for Clarendon Hills
indicates the property

The Planning and Zoning Board will hear the request for annexation and
zoning at its regular monthly meeting on December 19, 1988.

RESOLUTION 88- 191
OF THE COUNCIL OF THE CITY OF FORT COLLINS
FINDING SUBSTANTIAL COMPLIANCE AND
INITIATING ANNEXATION PROCEEDINGS FOR THE
ORCHARD ANNEXATION
WHEREAS, a written petition, together with four (4) prints of an
annexation map, was heretofore filed with the City Clerk requesting the
annexation of certain property to be known as the Orchard Annexation; and
WHEREAS, the City Council desires to initiate annexation proceedings
in accordance with law.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the City Council hereby accepts the annexation
petition for the Orchard Annexation, more particularly described as situate
in the County of Larimer, State of Colorado, to wit:
A tract of land located in the Southwest Quarter of Section 2,
Township 6 North, Range 69 West of the 6th Principal Meridian,
Larimer County, Colorado, being more particularly described as
follows:
Considering the South line of the Southwest Quarter of said
Section 2 as bearing North 88°26'52" East and with all bearings
contained herein relative thereto:
Beginning at the Southwest corner of said Southwest Quarter of
Section 2, thence along said South line of the Southwest Quarter
North 88°26'52" East 1310.22 feet to the West line of the East
One-half of said Southwest Quarter (said West line also being the
East line of Voc Tech/Smith Annexation to the City of Fort
Collins, Colorado); thence along said West line North 00°07'36"
East 1894.28 feet to a point on the North line of Applewood
Estates, Larimer County, Colorado; said point being the True
Point of Beginning; thence along the North line of said Applewood
Estates North 88°38'22" East 352.56 feet to the West line of that
tract of land described in Book 1631, Page 461 records of said
county; thence along said West line North 00°18'32" East 746.51
feet to a point on the North line of the East One-half of said
Southwest Quarter (said point also being on the Southerly line of
Voc Tech/Smith Annexation to the City of Fort Collins, Colorado);
thence along said North line South 89°28'53" West 354.85 feet to
the West line of the East One-half of said Southwest Quarter

Annexation to the City of Fort Collins, Colorado); thence along
said West line South 00°07'36" West 751.66 feet to the True Point
of Beginning. Said tract contains 6.08 acres, more or less, and
is subject to all easements and rights -of -way of record.

Section 2. That the City Council hereby finds and determines that the
annexation petition and accompanying map are in substantial compliance with
the Municipal Annexation Act, and desires to initiate annexation
proceedings in accordance with law.
Section 3. That the Notice attached hereto be adopted as a part of
this Resolution. Said Notice establishes the date, time and place when a
public hearing will be held regarding the passage of an annexation
ordinance pertaining to the above described property. The City Clerk is
directed to publish a copy of this Resolution and said Notice as provided
in the Municipal Annexation Act.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 6th day of December, A.D. 1988.

ANNEXING PROPERTY KNOWN AS THE
ORCHARD ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
WHEREAS, Resolution 88-191, finding substantial compliance and
initiating annexation proceedings, has heretofore been adopted by the
Council of the City of Fort Collins; and
WHEREAS, the Council of the City of Fort Collins has found and
determined and does hereby find and determine that it is in the best
interests of the City of Fort Collins to annex said area to the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the following described property, to wit:

Section 2. That, in annexing said property to the City of Fort
Collins, the City of Fort Collins does not assume any obligation respecting
the construction of water mains, sewer lines, gas mains, electric service
lines, streets or any other services or utilities in connection with the
property hereby annexed except as may be provided by the ordinances of the
City of Fort Collins.
Section 3. That the City of Fort Collins hereby consents, pursuant to
Section 37-45-136(3.6), C.R.S., to the inclusion of said property into the
Municipal Subdistrict, Northern Colorado Water Conservancy District.

AMENDING CHAPTER 29 OF THE CODE OF THE
CITY OF FORT COLLINS, COMMONLY KNOWN AS THE
ZONING ORDINANCE, AND CLASSIFYING FOR ZONING PURPOSES
THE PROPERTY INCLUDED IN THE
ORCHARD ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows:
Section 1. That the Zoning District Map adopted by Chapter 29 of the
Code of the City of Fort Collins be, and the same hereby is, changed and
amended by including the property known as the Orchard Annexation to the
City of Fort Collins, Colorado, in the R-L-P Low Density Planned
Residential District:
A tract of land located in the Southwest Quarter of Section 2,
Township 6 North, Range 69 West of the 6th Principal Meridian,
Larimer County, Colorado, being more particularly described as
follows:
Considering the South line of the Southwest Quarter of said
Section 2 as bearing North 88°26'52" East and with all bearings
contained herein relative thereto:

NOTICE
PLEASE TAKE NOTICE that the City Council of the City of Fort Collins
has adopted a Resolution initiating annexation proceedings for the Orchard
Annexation, said Annexation being more particularly described in said
Resolution, a copy of which precedes this Notice.
That, on January 17, 1989, at the hour of 6:30 p.m., or as soon
thereafter as the matter may come on for hearing in the Council Chambers in
the City Hall, 300 Laporte Avenue, Fort Collins, Colorado, the Fort Collins
City Council will hold a public hearing upon the annexation petition for
the purpose of finding and determining whether the property proposed to be
annexed meets the applicable requirements of Colorado law and is considered
eligible for annexation. At such hearing, any persons may appear and
present such evidence as they may desire.
