HomeMy WebLinkAboutBESSETT RESERVATION PLAT - 97-88 - LEGAL DOCS - LEGAL DOCUMENTSRESOLUTION 88-8 OF THE PLANNING AND ZONING BOARD OF THE CITY OF FORT COLLINS ADOPTING AND APPROVING THE BESSETT RESERVATION PLAT AND RECOMENDING THE IANDS Z!HEREON BE RESERVED FOR FUTURE ACQUISITTON FOR PUBLIC STREET PURPOSES WHEREAS, Colorado law provides in Section 31-23-220, C.R.S., that the Planning and Zoning Board is empowered to :Hake surveys for the exact location of the lines of a street in the City and to make a plat of the area thus surveyed showing the lands w:zio`-i the Board recommr_nds be reserved for future acquisition for public street purposes; and WHEREAS, Lets 7, 8, 9, 10, 11 and 12, Block 4, Replat No. 1, Evergreen Park, City of Fort Collins, fall within the anticipated right-of-way of the Fort Collins Expressway as desired by the State Department of usghways; and WHEREAS, the Board has determined that it is in the best interest of the citizens of the City that the right-of-way for the purposes of the Fort Collins Expressway be preserved free from development to the extent reasonably feasible; and WHEREAS, the Board has further determined that it is in the best interest of the citizens of the City that the aforesaid property be reserved for future acquisition in accordance with Colorado law. \Ta , THERn 'ORE, BE IT R SOLVED By THE PLANNING AIrTDi ZONING FIJARD OF TtE CITY OF FORT COLLINS as follows: Section 1. That the Bessett Reservation Plat be approved and adopted, which plat shows the locations of the lines of a street anticipated to be laid upon the lands described thereon. Section 2. That the Planning and Zoning Board hereby recommends to the City Council that the lands described upon said Plat be reserved for future acquisition for public street purposes until December 31, 1993. Said date may be modified by the City Council as it may deem appropriate in the interest of the public welfare without returning to the Planning and Zoning Board for additional approval as Otherwise may be required pursuant to Section 31-23-220(1)(b), C.R.S. Section 3. That the Planning and Zoning Board further recommends that the Council consider as an alternative to the reservation of the subject premises, the negotiation of a lease of the subject premises upon terms acceptable to the City.
