RE: State Highway Annexations
Dear Mr. Jacobson:
The City of Fort Collins would like to annex a parcel of land owned by the
State Department of Highways. The property is 110.6344 acres of Interstate
Highway 25 right of way located between County Road 48 and County Road
52. The proposed annexation is known as Highway I-25 First Annexation.
It is the city's policy to annex properties within the Urban Growth Area when
they become eligible for annexation. This portion of I-25 right of way is
contiguous to Vine Business Park Annexation and Allen, Lind and Moore
Annexation on the west and to Front Range Farms II and Buckeye
Farms/Einarsen .Annexation on the east. (See attached map of current annexa-
tions.) Having these properties under the city's jurisdiction makes it easier to
plan long term capital improvements and also insures that new development
will be designed to meet city standards.
This action is not being taken for the sole purpose of acquiring jurisdiction
over private property. Our office has prepared the petition package according
to your Procedural Directive No. 1303.1 dealing with annexation of Department
land to a city or town. Additional information required by the District is
summarized below.
(a) The Department of Highways will not be subject to taxes or
assessments by special improvement districts.
(b) Water service is presently available through East Larimer Water
District. the property is not in a wastewater district.
(c) The City of Fort Collins shall be the issuing authority on access
matters. The Department of Highways would review access pro-
posals and issue the required Access Permits to the City. All
access considerations shall be resolved pursuant to Section
42-2-147(5)(a), C.R.S., and the State Highway Access Code 2 CCR
601-1.

(d) The State Department of Highways shall continue to assume the
primary responsibility for traffic enforcement and accident
investigation for the annexed area until such time that future
development warrants the consistent deployment of city officers
to the area. (See attached letters.)
