Dear Mr. Luthi,
I appreciated both your phone call and note on CBW and the issue of small
generator waste. Your comments were both thoughtful and incisive on the
issues of quantity, toxicity, and handling.
As discussed with you, these issues are not covered in the performance stan-
dards (Section 29-368 of the City Code) which we use to review projects.
Rather these issues of environmental concern are regulated by the Federal and
state government under the aegis of the Environmental Protection Agency and
the Colorado Department of Health.
Both the federal and state governments maintain considerable expertise and
regulatory authority. The city does not have the legislative authority and
mandate to pursue your concerns.
The Poudre Fire Authority does have the ability to review storage of hazar-
dous materials. They review building plans for every new industrial structure
in Fort Collins.
For your information, the City has taken the lead in Colorado of considering
regulations to handle the problems of leaking underground storage tanks, rather
than wait for the Colorado Legislature to act.
Perhaps, in your new role as a member of the Natural Resources Board, you
can be of assistance in raising some of the aforementioned issues.
Brian Woodruff could certainly shed some light on the attempt by some con-
cerned citizens last year to develop an educational program for small waste
generators. The Chamber of Commerce has been involved in an educational
effort this year on the same issue.

I would certainly be available to you, your executive committee and your
organization to discuss the existing performance standards as well as your
concerns and observations about the LDGS and the Urban Growth Area Agree-
ment.
