The requested zoning is the I-G, General Industrial District. RECOMMENDATION: Staff recommends approval of the annexation. Staff recommends approval of the I-G zoning request with a PUD condition. EXECUTIVE SUMMARY: This is a request to annex and zone approximately 38.24 acres located predominantly south of Vine Drive and east of Summit View Road. The requested zoning is the I-G, General Industrial District. The property is presently undeveloped. The property is currently zoned I -Industrial in the County. This is a voluntary annexation. PLANNING DEPARTMENT Fort Collins Industrial & Technical Park Venture First Annex. and Zoning - #3-89,A February 27, 1989 P & Z Meeting - Page 2 Background: The applicant and owner, Fort Collins Industrial & Technical Park Venture, has submitted a written petition requesting annexation of approximately 154 acres located south of Vine Drive and east of Summit View Road. In order to meet contiguity requirements for annexation under State law, the property is being submitted as two annexations, the Fort Collins Industrial & Technical Park Venture First (38.19 total acres) and Second (119.24 total acres) Annexa- tions. The requested zoning is the I-G, General Industrial District. The property is presently undeveloped. The property is currently zoned I -Industrial in the County. This is a voluntary annexation. Any existing commercial signs on the property will have to conform to the City's Sign Code at the conclusion of a five year amortization period. The property is located within the Fort Collins Urban Growth Area. According to policies and agreements between the City of Fort Collins and Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA, the City will annex property in the UGA when the property is eligible for annexation according to State law. The property gains the required 1/6 contiguity to existing city limits from a common boundary with the East Vine Drive 7th Annexation to the northeast. The surrounding zoning and existing land uses are as follows: N: FA-1, Farming, undeveloped. E: I -Industrial, undeveloped. S: I -Industrial, gravel extraction operation. W: O-Open, mobile home park. The requested zoning for this annexation is the I-G, General Industrial District. The I-G District designation is for heavy industrial uses. Any use, except a residential use, is allowed in the I-G zone. The property will probably eventually develop with a combination of commercial, business, and industrial uses. According to the City's LAND USE POLICIES PLAN, industrial uses should locate in the city, near transportation facilities that offer the required access to the industry but will not be allowed to create demands which exceed the capacity of the existing and future transportation network of the City, and in areas where the proper sizing of facilities such as water, sewer, and transportation has occurred or is planned. This site addresses these locational policies. There are no immediate development plans for the property. Because the I-G zone essentially allows any commercial, business, and industrial use, as "use -by -right," staff feels a PUD condition should be applied to the property to protect adjacent properties from potential incompatible uses. The PUD condition would require all development proposals to be reviewed against the criteria of the LAND DEVELOPMENT GUIDANCE SYSTEM. The annexation of this area is consistent with the policies and agreements between Larimer County and the City of Fort Collins contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA. 2. The area meets all criteria included in State law to qualify for a voluntary annexation to the City of Fort Collins. 3. On February 7, 1989, the City Council approved a resolution which accepts the annexation petition and determines that the petition is in compliance with State law. The resolution also initiates the annexation process for this property by establishing the date, time and place when a public hearing will be held regarding the readings of the Ordinances annexing and zoning the area. Public hearing and first reading of the Ordinances annexing and zoning the property will be considered by the City Council on March 21, 1989. 4. The requested I-G, General Industrial Zoning District is in conformance with the policies of the City's Comprehensive Plan. STAFF RECOMMENDATION Staff recommends approval of the annexation and requested I-G zoning with a PUD condition. :�aa Develop,nt Services . Fort Collins Industrial and Technical Park Venture 2nd Annexation. DATE OF REVIEW BY THE FORT COLLINS CITY COUNCIL: March 21, 1989 The purpose of this report is to satisfy the requirements of CRS 31-12-108.5 which indicates a municipality shall prepare an annexation impact report and file a copy of the report with the Board of County Commissioners governing the area proposed to be annexed. Attached to this report are the following: (aI) A map showing the present and proposed boundaries of the City of Fort Collins in the vicinity of the above referenced annexation. The proposed boundaries of the City of Fort Collins are depicted by the Urban Growth Area boundary as agreed to by the Larimer County Board of Commissioners and the Council of the City of Fort Collins and contained in the INTERGOVERNMEN- TAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA. (See Exhibit A). (aII) A map showing present streets, major water trunk lines, sewer interceptors and outfalls, other utility lines and ditches, and the proposed extension of such streets and utility lines in the vicinity of the above referenced annexation. (See, Fort Collins Urban Growth Area Master Street Plan for present and proposed extension of streets; Water Master Plan 1986 for present and proposed extension of water utility lines; Sewer Master Plan 1986 for present and proposed extension of sewer utility lines; and Exhibit B for other utility lines and ditches). (aIII) The areas of the proposed annexations are presently vacant and, at this time, the petitioner has no immediate development plans for the property. (b) There is no pre -annexation agreement between the petitioner and the City of Fort Collins associated with the above referenced annexations. (c) The City of Fort Collins plans to extend municipal services into the area of the above referenced annexation. The City operates under a "develop- ment must pay its own way" philosophy whereby, the cost of needed extensions of infrastructure (utilities and streets) are borne by the developer requiring those extensions. The City participates in any required "oversizing" of infrastructure and finances such requirements from the City's Oversizing Fee structure. The developer has several optional methods to finance infrastructure extensions including the use of Special Improvement Districts (SIDs). The City also collects fees for the extension and upgrading of storm drainage systems and the purchase and construction of parks and recreational facilities. Other • municipal services, such as police protection, are financed from the City's General Fund. (d) The following districts presently provide service within the above referenced annexation: SCHOOL DISTRICT Poudre R-I School District FIRE DISTRICT Poudre Valley Fire District HOSPITAL DISTRICT Poudre Valley Hospital District PEST CONTROL DISTRICT Larimer County Pest Control SANITATION DISTRICT Boxelder Sanitation District WATER DISTRICT East Larimer Water District N. CO Water Conservancy District ELECTRIC POWER Poudre Valley REA, Inc. (f) It is unlikely the property will develop with residential land uses, therefore, there will be no impact on the Poudre R-1 School District. All rights -of -way of adjacent County Roads as well as the eastern half on County Road 9E are included in these annexations. That it is desirable and necessary that such area be annexed to the City of Fort Collins. 2. That the requirements of Sections 31-12-104 and 31-12-105, C.R.S. 1973, exist or have been met. 3. That not less than one -sixth of the perimeter of the area proposed to be annexed is contiguous with the boundaries of the City of Fort Collins. 4. That a community of interest exists between the area proposed to be annexed and the City of Fort Collins. 5. That the area to be annexed is urban or will be urbanized in the near future. 6. That the area proposed to be annexed is integrated with or capable of being integrated with the City of Fort Collins. 7. That the amendment to Article II of the Constitution of the State of Colorado, passed on November 4, 1980, establishing the require- ment that an annexing municipality receive a petition for annexa- tion signed by tire than 500 of the landowners in the area owning more than 50% of the land in the area, exclusive of streets and alleys, has been complied with. WHEREFORE, said petitioners request that the Council of the City of Fort Collins approve the annexation of said area. Furthermore, the peti- tioners request that said area be placed in the See Exhibit B attached hereto Zoning Dis- trict pursuant to Chapter 118 (Zoning) of the Code of the City of Fort Col- lins.
