Second Reading of Ordinance No. 82, 1989, Annexing Approximately 46 Acres Known as Milne Annexation. B. Second Reading of Ordinance No. 83, 1989, Zoning Approximately 46 Acres Known as Milne Annexation, into the R-C, River Corridor District. On May 2, Council unanimously adopted Resolution 89-99 Setting Forth Findings of Fact and Determinations and unanimously adopted on First Reading Ordinance No. 82, 1989 and Ordinance No. 83, 1989. These Ordinances annex and zone approximately 46 acres, located north of Prospect, 1/2 mile east of Timberline Road. The requested zoning is the R-C, River Corridor District. Hearing and First Reading of Ordinance No. 82 1989, Annexing Approximately 46 Acres Known as Milne Annexation. C. Hearing and First Reading of Ordinance No. 83 , 1989, Zoning Approximately 46 Acres Known as Milne Annexation, into the R-C, River Corridor District. This is a request to annex and zone approximately 46 acres, located north of Prospect, 1/2 mile east of Timberline Road. The requested zoning is the R-C, River Corridor District. APPLICANT: City of Fort Collins OWNER: Same BACKGROUND: The City of Fort Collins is requesting annexation of approximately 46 acres, located north of Prospect, 1/2 mile east of Timberline. This property was acquired by the City through an open space donation in 1988 and contains two ponds that were created by previous gravel extraction. This is a voluntary annexation. The property is located within the Fort Collins Urban Growth Area. According to policies and agreements between the City of Fort Collins and Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA, the City will annex property in the UGA when the property is eligible for annexation according to State law. The property gains the required 1/6 contiguity to existing city limits from a common boundary with the Riverbend Annexation to the north. The requested zoning for this annexation is the R-C, River Corridor District. The R-C District Designation is for areas developing within the Downtown River Corridor of DATE: May 2, 1989 1W-2- ITEM NUMBER: 11 the Cache La Poudre River. Since the property is located within the Cache La Poudre River floodplain, any development on the property would be severely restricted. The property is best suited or open space and recreational use. State law requires that within ninety days of when property is annexed, it is given a zoning designation. The proposed zoning is consistent with the City's Comprehensive Plan. There are no development plans for the property. FINDINGS: 1. The annexation of this area is consistent with the policies and agreements between Larimer County and the City of Fort Collins contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA. 2. The area meets all criteria included in State law to qualify for a voluntary annexation to the City of Fort Collins. 3. The requested R-C, River Corridor District is in conformance with the policies of the City's Comprehensive Plan. PLANNING AND ZONING BOARD RECOMMENDATION: The Planning and Zoning Board heard this request at its regular monthly meeting on March 27, 1989 and voted 7-0 to recommend approval of the annexation and zoning.
