Staff recommends adoption of the Resolution and adoption of the Ordinances
on First Reading.

C. Hearing and First Reading of Ordinance No. 83 1989, Zoning
Approximately 46 Acres Known as Milne Annexation, into the R-C, River
Corridor District.
This is a request to annex and zone approximately 46 acres, located north
of Prospect, 1/2 mile east of Timberline Road. The requested zoning is the
R-C, River Corridor District.
APPLICANT: City of Fort Collins OWNER: Same
BACKGROUND:
The City of Fort Collins is requesting annexation of approximately 46
acres, located north of Prospect, 1/2 mile east of Timberline. This
property was acquired by the City through an open space donation in 1988
and contains two ponds that were created by previous gravel extraction.
This is a voluntary annexation.
The property is located within the Fort Collins Urban Growth Area.
According to policies and agreements between the City of Fort Collins and
Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT
COLLINS URBAN GROWTH AREA, the City will annex property in the UGA when the
property is eligible for annexation according to State law. The property
gains the required 1/6 contiguity to existing city limits from a common
boundary with the Riverbend Annexation to the north. The requested zoning
' for this annexation is the R-C, River Corridor District. The R-C District
Designation is for areas developing within the Downtown River Corridor of

the Cache La Poudre River. Since the property is located within the Cache
La Poudre River floodplain, any development on the property would be
severely restricted. The property is best suited for open space and
recreational use. State law requires that within ninety days of when
property is annexed, it is given a zoning designation. The proposed zoning
is consistent with the City's Comprehensive Plan. There are no development
plans for the property.
FINDINGS:
1. The annexation of this area is consistent with the policies and
agreements between Larimer County and the City of Fort Collins
contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN
GROWTH AREA.
2. The area meets all criteria included in State law to qualify for a
voluntary annexation to the City of Fort Collins.
3. The requested R-C, River Corridor District is in conformance with the
policies of the City's Comprehensive Plan.
PLANNING AND ZONING BOARD RECOMMENDATION•
The Planning and Zoning Board heard this request at its regular monthly
meeting on March 27, 1989 and voted 7-0 to recommend approval of the
annexation and zoning.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
SETTING FORTH FINDINGS OF FACT AND DETERMINATIONS
REGARDING THE MILNE ANNEXATION
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1. That the City Council hereby finds that the area proposed
to be annexed as the Milne Annexation is solely owned by the City of Fort
Collins and is not solely a public street or right-of-way.
Section 2. That the City Council concludes that the area proposed to
be annexed is eligible for annexation to the City of Fort Collins in
accordance with the provisions of Sections 31-12-104(1)(a) and 31-12-105,
C.R.S., and should be so annexed.
Section 3. That the City Council hereby finds that said area may be
annexed by ordinance without notice and hearing.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 2nd day of May, A.D. 1989.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
ANNEXING PROPERTY KNOWN AS THE
MILNE ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
WHEREAS, the area to be annexed is solely owned by the City of Fort
Collins and is not solely a public street or right-of-way; and
WHEREAS, the Council of the City of Fort Collins has found and
determined and does hereby find and determine that it is in the best
interests of the City of Fort Collins to annex said area to the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the following described property, to wit:
A tract of land situate in the South one-half of Section 17 and
the North one-half of Section 20, Township 7 North, Range 68 West
of the 6th P.M., Larimer County, Colorado, which considering the
South line of the Southeast Quarter of said Section 17 as bearing
S 89°3255" E and with all bearings contained herein relative
thereto is contained within the boundary lines which begin at the
South one -quarter corner of said Section 17 and run thence
S 89°32'55" E 642.32 feet along said South line to the true point •
of beginning; thence N 00°21'15" E 185.00 feet; thence
N 00°21'15" E 433.43 feet; thence N 08°35'45" W 268.67 feet to a
pointon the boundary of Riverbend Second Annexation to the City
of Fort Collins; thence along said Annexation N 82°54'20" E
971.46 feet; thence N 01*49'21" E 176.80 feet; thence
N 89°48'28" E 1054.10 feet; thence leaving said Annexation and
along the East line of said Southeast Quarter S 00°11'32" E

S 00°11'32" E 400.00 feet to the South line of said Section 17;

be, and hereby is, annexed to the City of Fort Collins and made a part of
said City, to be known as the Milne Annexation.
Section 2. That, in annexing said property to the City, the City does
not assume any obligation respecting the construction of water mains, sewer
lines, gas mains, electric service lines, streets or any other services or
utilities in connection with the property hereby annexed except as may be
provided by the ordinances of the City.
Section 3. That the City hereby consents, pursuant to Section
37-45-136(3.6), C.R.S., to the inclusion of said property into the
Municipal Subdistrict, Northern Colorado Water Conservancy District.

AMENDING CHAPTER 29 OF THE CODE OF THE
CITY OF FORT COLLINS, COMMONLY KNOWN AS THE
ZONING ORDINANCE, AND CLASSIFYING FOR ZONING PURPOSES
THE PROPERTY INCLUDED IN THE
MILNE ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows:
Section 1. That the Zoning District Map adopted by Chapter 29 of the
Code of the City of Fort Collins be, and the same hereby is, changed and
amended by including the property known as the Milne Annexation to the City
of Fort Collins, Colorado, in the RC River Corridor District:
