SUBJECT
Resolution 89-66 Stating the Intent and Initiating Annexation Proceedings
for Milne Annexation.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
The City of Fort Collins is the applicant and owner of the property to be
annexed, which is 46 acres, located north of Prospect, 1/2 mile east of
Timberline Road.
The proposed Resolution makes a finding that the proposed annexation
substantially complies with the Municipal Annexation Act as a
municipally -owned property that can be annexed by ordinance without notice
and hearing.
BACKGROUND:
The property is located within the Fort Collins Urban Growth Area.
According to policies and agreements between the City of Fort Collins and
Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT
COLLINS URBAN GROWTH AREA, the City will annex property in the UGA when the
property is eligible for annexation according to State law. The property
gains the required 1/6 contiguity to existing city limits from a common
boundary with the Riverbend Second Annexation to the north.
PLANNING AND ZONING BOARD RECOMMENDATION:
The Planning and Zoning Board will consider this item at its regular
monthly meeting of March 27, 1989.

RESOLUTION 89- 66
OF THE COUNCIL OF THE CITY OF FORT COLLINS
STATING THE INTENT OF THE CITY OF FORT COLLINS
TO ANNEX CERTAIN PROPERTY AND
INITIATING ANNEXATION PROCEEDINGS FOR SUCH PROPERTY
TO BE KNOWN AS THE MILNE ANNEXATION
WHEREAS, the area proposed to be annexed as the Milne Annexation is
solely owned by the City of Fort Collins and is not solely a public street
or right-of-way; and
WHEREAS, the area proposed to be annexed is eligible for annexation to
the City in accordance with the provisions of Sections 31-12-104(1)(a) and
31-12-105, C.R.S., and should be so annexed; and
WHEREAS, said area may be annexed by ordinance without notice and
hearing; and
WHEREAS, the Council of the City of Fort Collins desires to initiate
annexation proceedings in accordance with law.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That, the Council intends to annex the following described
property, to be known as the Milne Annexation, situate in the County of
Larimer, State of Colorado, to wit:
A tract of land situate in the South one-half of Section 17 and
the North one-half of Section 20, Township 7 North, Range 68 West
of the 6th P.M., Larimer County, Colorado, which considering the
South line of the Southeast Quarter of said Section 17 as bearing
S 89°32'55" E and with all bearings contained herein relative
thereto is contained within the boundary lines which begin at the
South one -quarter corner of said Section 17 and run thence
S 89032'55" E 642.32 feet along said South line to the true point
of beginning; thence N 00°21'15" E 185.00 feet; thence
N 00°21'15" E 433.43 feet; thence N 08°35'45" W 268.67 feet to a
point on the boundary of Riverbend Second Annexation to the City
of Fort Collins; thence along said Annexation N 82°54'20" E
971.46 feet; thence N 01*49'21" E 176.80 feet; thence
N 89048'28" E 1054.10 feet; thence leaving said Annexation and
along the East line of said Southeast Quarter S 00°11'32" E
800.00 feet; thence N 89°32'55" W 504.40 feet; thence
S 00°11'32" E 400.00 feet to the South line of said Section 17;
thence S 00°11'32" E 30.00 feet; thence N 89°3255" W 689.75
feet; thence S 00°28'04" W 15.00 feet; thence N 89°32'55" W
797.60 feet; thence N 00°21'15" E 45.00 feet to the point of
beginning. Containing 46.0644 acres.

Section 2. That the Council of the City of Fort Collins hereby
initiates annexation proceedings for the above described property, and will
consider the annexation ordinance at its regular meeting scheduled on May
2, 1989.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 21st day of March, A.D. 1989.
