Resolution 89-64 Stating Intent to Annex Certain Property and Initiating
Annexation Proceedings for the Harmony Annexation No. 6.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
The property being considered for annexation has, for a period of not less
than three (3) years, been completely surrounded by property contained
within the boundaries of the City of Fort Collins. The property being
considered for annexation is approximately 80.79 acres in size and is
located south of Harmony Road and west of Timberline Road.
The proposed Resolution determines that it is in the best interest of the
E citizens of the City to annex the area and that the annexation complies
with the Municipal Annexation Act. The Resolution also determines that a
hearing should be established regarding the annexation, and directs that
notice to be given of the hearing. The hearing will be held at the time of
first reading of the annexation and zoning ordinances. A public hearing on
the annexation is not required by Colorado law.
BACKGROUND:
The property is located within the Fort Collins Urban Growth Area.
According to policies and agreements between the City of Fort Collins and
Larimer County contained in the Intergovernmental Agreement for the Fort
Collins Urban Growth Area, the City will annex property in the UGA when the
property is eligible for annexation according to state law. The property
became completely surrounded by the City of Fort Collins through the
following annexations:
N: Harmony Annexation No. 2, September 6, 1977.
E: Harmony Annexation No. 2, September 6, 1977.
South Harmony Annexation, February 4, 1986.
S: South Harmony Annexation, February 4, 1986.
W: Keenland Annexation, August 19, 1980.
Harmony 1st Annexation, August 2, 1977.

RESOLUTION 89- 64
OF THE COUNCIL OF THE CITY OF FORT COLLINS
STATING THE INTENT OF THE CITY OF FORT COLLINS
TO ANNEX CERTAIN PROPERTY AND
INITIATING ANNEXATION PROCEEDINGS FOR SUCH PROPERTY
TO BE KNOWN AS THE HARMONY ANNEXATION NO. 6
WHEREAS, the property hereinafter described has, for a period of not
less than three (3) years prior to this date, been completely contained
within the boundaries of the City of Fort Collins; and
WHEREAS, the Council of the City of Fort Collins has determined that
it is in the best interests of the citizens of the City to annex said area
to the City, as required by the terms of the Intergovernmental Agreement
between the City and Larimer County, Colorado, dated September 7, 1988; and
WHEREAS, the Council of the City of Fort Collins desires to initiate
annexation proceedings in accordance with law.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That, the Council intends to annex the following described
property, to be known as the Harmony Annexation No. 6, situate in the
County of Larimer, State of Colorado, to wit:
A tract of land situate in the Northeast Quarter of Section 6,
Township 6 North, Range 68 West of the 6th P.M., Larimer County,
State of Colorado, which considering the East line of said
Northeast Quarter as bearing S 00°30'12" E and with all bearings
contained herein relative thereto is contained within the
boundary lines which begin at that Northeast corner of said
Section 6, and run thence S 00°30'12" E 170.00 feet to the true
point of beginning, which point lies on the East line of said
Northeast Quarter; thence run along said East line S 00°30'12" E
2430.79 feet to the East one -quarter corner of said Section 6;
thence along the East-West centerline of said Section 6
N 89059'38" W 1738.53 feet; thence N 14'22'30" E 1354.59 feet;
thence S 89°54'15" W 25.82 feet; thence N 14°24'06" E 919.98
feet; thence along the arc of a 3894.83 foot radius curve to the
left a distance of 316.80 feet, the long chord of which bears
N 11052'34" E 316.71 feet; thence S 81°32'02" E 199.69 feet;
thence along the arc of a 5830.00 foot radius curve to the left a
distance of 25.90 feet, the long chord of which bears
S 84°37'10" E 25.90 feet; thence along the arc of a 5830.00 foot
radius curve to the left a distance of 513.36 feet, the long
chord of which bears S 87°16'10" E 513.20 feet; thence
N 82029'20" E 52.08 feet; thence N 82°29'20" E 134.02 feet;
thence S 89°47'25" E 112.90 feet; thence S 45'07'40" E 71.10
feet; thence S 89°47'25" E 29.00 feet to the true point of
beginning.
Containing 80.7896 acres. 0
Section 2. That the Council of the City of Fort Collins hereby
initiates annexation proceedings for the above described property.
Section 3. That the Notice attached hereto be adopted as a part of
this Resolution. Said Notice establishes the date, time and place when a
hearing will be held regarding the passage of an annexation ordinance
pertaining to the above described property. The City Clerk is directed to
publish a copy of this Resolution and said Notice as provided in Section
31-12-108(2), C.R.S.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 21st day of March, A.D. 1989.

TO ALL PERSONS INTERESTED:
NOTICE
PLEASE TAKE NOTICE that the City Council of the City of Fort Collins
has adopted a Resolution initiating annexation proceedings for the Harmony
Annexation No. 6, said Annexation being more particularly described in said
Resolution, a copy of which precedes this Notice.
That, on May 2, 1989, at the hour of 6:30 p.m., or as soon thereafter
as the matter may come on for hearing in the Council Chambers in the City
Hall, 300 Laporte Avenue, Fort Collins, Colorado, the Fort Collins City
Council will hold a hearing for the purpose of finding and determining
whether the property proposed to be annexed meets the applicable
requirements of Colorado law and is considered eligible for annexation.
