Dear D. L. & G. Partnership,
On February 24, 1989, I sent a letter to you indicating that property which
you own, and located south of Harmony Road and west of Timberline Road,
was being included in an enclave annexation to the City of Fort Collins, called
the Harmony Annexation No. 6. In my letter of February 24, I also indicated
that City staff would be recommending your property be placed into the I-L,
limited Industrial, Zoning District, and listed the uses which are allowed in the
I-L Zone. I also stated that although the predominant use of your property is a
warehouse, and a warehouse is an allowed use in the I-L Zone, the use will
be classified as a non -conforming use since it was developed under County
Zoning Regulations and not approved through a site plan review conducted by
the City's Director of Planning as required for that type of use by the I-L
Zone. I also indicated that changes of use can be approved through the City's
"change to a non -conforming use" process which requires a public hearing
before the Planning and Zoning Board; or changes of use can be approved by
submitting a site plan and having that site plan approved by the Director of
Planning.
Recent decisions concerning I-L zonings by the City of Fort Collins Planning
and Zoning Board on properties along Harmony Road have indicated that the
Board is not willing to place such properties into the I-L Zone without a
Planned Unit Development (PUD) zoning condition. A PUD zoning condition
requires all new development to be reviewed under the City's PUD ordinance,
known as the Land development Guidance System. A PUD condition does not
change the non -conforming status of the existing building. Changes can still
be approved through the "change to a non -conforming use" process which
requires a public hearing before the Planning and Zoning Board.
Because of the Board's recent decisions concerning I-L zonings along Harmony
Road, City staff is changing its zoning recommendation on your property to
include a PUD condition. The Harmony Annexation No. 6 will be reviewed by
the Fort Collins Planning and Zoning Board on March 27, 1989. The meeting
will be held in the City Council Chambers located in City Hall West at 300
LaPorte Avenue starting at 6:30 PM. The Board will conduct a public hearing
and make a recommendation on the annexation to the Fort Collins City Coun-
cil. The City Council will consider official annexation of the property via
ordinance on May 2, 1989.
