Attorneys at Law 210 East 29th Street Loveland, CO 80538 RE: Mars Landing – File Number PDP190013 – Comments of the North Loudon Ditch and Reservoir Company Dear Randy Starr: We received comments issued by the North Loudon Ditch and Reservoir Company on June 22, 2021 regarding the above referenced Site Plan proposal. Please see below written responses addressing each of the comments. 1. The Ditch Company signed (and recorded 7/2/2018 Reception Number 20180040080) an agreement with the prior property owner which owned the applicant’s “Mars Landing” [Subdivision] land describing the relocation of the Company’s ditch that is now located on the westerly side of the “Mars Landing” property. A copy of the Agreement is attached to this letter. The Agreement is binding on the title to the applicant’s Subdivision property. The pipe carrying irrigation water of the Company is located on the land west of the “Mars Landing” property and it comes to daylight south of Skyview Drive just west of the “Mars Landing” property. Irrigation water is carried north in an open ditch under Skyview Drive. The underground irrigation pipe will remain in place as will the open ditch. The existing open ditch is necessary to convey irrigation water and emergency flows through the pipe and ditch from the south to the north. No change in these structures will be made by the Company or the owner of the Mars Landing property. Any maintenance, repairs or replacement of the existing irrigation pipe are to be performed only following approval by the Company with all costs borne to the property owners. Response: Comment noted. There are no proposed improvements or disturbances to the existing North Loudon Ditch and Reservoir Company infrastructure as outlined and constructed per the Agreement. Please find an exhibit attached with this letter demonstrating the location of the existing ditch company infrastructure and easement as it relates to the Mars Landing project. 2. The plans submitted by the Mars Landing applicant do not show the Company’s easement and location of the underground pipe and the open ditch. The “Mars Landing” plan apparently shows no crossing of the pipe and ditch of the Company. If a crossing would be necessary, whether for roads, utilities, or other facilities, then the Company would require that no crossing of its ditch will be allowed without the prior written approval of the Company. Response: There are no proposed crossings of the Company’s easement, pipe, and open ditch. 3. The Company would identify to the applicant and the City that there may be subsurface waters that arise in the area of the “Mars Landing” development, and there are periods of time when, due to water flowing within the ditch system and otherwise, that portions of the “Mars Landing” property could receive significant amounts of subsurface water and water that is very near to the surface or resides on the surface. Due to this situation, the utility of certain portions of the “Mars Landing” Mars Landing North Loudon Ditch Company Comments August 3, 2021 Galloway & Company, Inc. Page 2 of 2 property for construction of structures could be impacted or unavailable. The Company has no plans to alter its operations as it would cure this surface and subsurface water issue. A note should be inserted on the plan of the Mars Landing Subdivision regarding these issues. The applicant’s drainage plan as submitted, does not appear to deal with surface flows that may occur out of the ditch onto the “Mars Landing” property, and the plan should provide for any overflow from the ditch system. Response: Comment noted. We will take into consideration this information for further design of the Mars Landing Utility Plans. Grading of the proposed project near the existing open area of the ditch to remain is designed to divert flows toward proposed drainage infrastructure.
