SUBJECT:
Items Related to the Fort Collins Substation Annexation and Zoning.
RECOMMENDATION:
Staff recommends approval of the annexation and zoning request. The
Planning and Zoning Board voted 6-0 to recommend approval of the annexation
and requested zoning.
EXECUTIVE SUMMARY:
A. Resolution 89-96 Setting Forth Findings of Fact and Determinations
Regarding the Fort Collins Substation Annexation and Zoning.
B. Hearing and First Reading of Ordinance No. 77 , 1989, Annexing
Approximately 5.47 Acres, Known as the Fort Collins Substation
Annexation.
C. Hearing and First Reading of Ordinance No. 78 1989, Zoning
Approximately 5.47 Acres, Known as the Fort Collins Substation
Annexation, Into the R-F, Foothills Residential, Zoning District.
This is a request to annex and zone approximately 5.47 acres located west
of Overland Trail and south of West Mulberry Street (extended). The
requested zoning is the R-F, Foothills Residential District. The property
is presently developed as an electric utility substation for the City of
Fort Collins Light & Power Department. The property is currently zoned
FA-1, Farming in the County. This is a voluntary annexation.

BACKGROUND: •
The applicant and owner, the City of Fort Collins, has requested annexation
of approximately 5.47 acres located west of Overland Trail and south of
West Mulberry Street (extended). The requested zoning is the R-F,
Foothills Residential District. The property is presently developed as an
electric utility substation for the City of Fort Collins Light & Power
Department. The property is currently zoned FA-1, Farming in the County.
This is a voluntary annexation.
The property is located within the Fort Collins Urban Growth Area.
According to policies and agreements between the City of Fort Collins and
Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT
COLLINS URBAN GROWTH AREA, the City will annex property in the UGA when the
property is eligible for annexation according to State law. The property
gains the required 1/6 contiguity to existing city limits from a common
boundary with the Brown's Annexation, the First Locust Grove Annexation,
the Overland Trail Anney,,ation and the Noe Annexation.to the southeast.
The surrounding zoning and existng and uses a as follows:
N: FA-1, Farming, residential development.
�W E: FA-1, Farming, residential development.
S: FA-1, Farming, residential development.
W: FA-1, Farming, residential development.
The requested zoning for this annexation is the R-F, Foothills Residential
District. The R-F District designation is for areas near the foothills.
The property is develop as a electric utility substation for the City's
\✓ Light & Power Department. Utility sub -stations are a "use -by -right" in the
,,)111R-F Zone. There are no immediate redevelopment plans for the property.

lFi� The annexation of this area is consistent with the policies and
agreements between Larimer County and the City of Fort Collins
contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN
GROWTH AREA.
2. The area meets all criteria included in State law to qualify for a
voluntary annexation to the City of Fort Collins.
On March 21, 1989, the City Council approved a resolution determining
that the annexation is in compliance with State law. The resolution
also initiated the annexation process for this property by establishing
the date, time and place when a public hearing will be held regarding
the readings of the Ordinances annexing and zoning the area.
The requested R-F, Foothills Residential District is in conformance
with the policies of the City's Comprehensive Plan.

STAFF RECOMMENDATION:
Staff recommends approval of the annexation and requested zoning.
PLANNING AND ZONING BOARD RECOMMENDATION:
The Planning and Zoning Board, at their regular monthly meeting of March
27, 1989, voted 6-0 to recommend approval of the annexation and requested
zoning as part of the Board's Consent Agenda.

RESOLUTION 89-96
OF THE COUNCIL OF THE CITY OF FORT COLLINS
SETTING FORTH FINDINGS OF FACT AND DETERMINATIONS
REGARDING THE FORT COLLINS SUBSTATION ANNEXATION
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS:
Section 1. That the City Council hereby finds that the area proposed
to be annexed as the Fort Collins Substation Annexation is solely owned by
the City of Fort Collins and is not solely a public street or right-of-way.
Section 2. That the City Council concludes that the area proposed to
be annexed is eligible for annexation to the City of Fort Collins in
accordance with the provisions of Sections 31-12-104(1)(a) and 31-12-105,
C.R.S., and should be so annexed.
Section 3. That the City Council hereby finds that said area may be
annexed by ordinance without notice and hearing.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 2nd day of May, A.D. 1989.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
ANNEXING PROPERTY KNOWN AS THE
FORT COLLINS SUBSTATION ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
WHEREAS, the area to be annexed is solely owned by the City of Fort
Collins and is not solely a public street or right-of-way; and
WHEREAS, the Council of the City of Fort Collins has found and
determined and does hereby find and determine that it is in the best
interests of the City of Fort Collins to annex said area to the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the following described property, to wit:
A tract of land situate in the Northwest Quarter of Section 16
and the East Half of Section 17, all in Township 7 North, Range
68 West of the 6th P.M., Larimer County, Colorado, which
considering the East line of the Northeast Quarter of said
Section 17 as bearing S 00°10'27" W and with all bearings
contained herein relative thereto, is contained within the
boundary lines which begin at the Northeast corner of said
Section 17 and run thence S 89°08'28" E 30.00 feet along the •
North line of said Section 16; thence S 00°10'27" W 978.41 feet;
thence S 00°10'27" W 341.07 feet, thence N 89°12'19" W 30.00 feet
to a point on the East line of said Section 17; thence
S 00°10'27" W 1319.56 feet to the East Quarter corner of said
Section 17; thence S 00°16'51" W 411.40 feet along the East. line

utilities in connection with the property hereby annexed except as may be
provided by the ordinances of the City.
Section 3. That the City hereby consents, pursuant to Section
37-45-136(3.6), C.R.S., to the inclusion of said property into the
Municipal Subdistrict, Northern Colorado Water Conservancy District.

ZONING ORDINANCE, AND CLASSIFYING FOR ZONING PURPOSES
THE PROPERTY INCLUDED IN THE
FORT COLLINS SUBSTATION ANNEXATION
TO THE CITY OF FORT COLLINS, COLORADO
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows:
Section 1. That the Zoning District Map adopted by Chapter 29 of the
Code of the City of Fort Collins be, and the same hereby is, changed and
amended by including the property known as the Fort Collins Substation
Annexation to the City of Fort Collins, Colorado, in the R-F Foothills
Residential District:
