RECOMMENDATION: Staff recommends adoption of the Ordinances on Second Reading. EXECUTIVE SUMMARY: A. Second Reading of Ordinance No. 77, 1989, Annexing Approximately 5.47 Acres, Known as the Fort Collins Substation Annexation. B. Second Reading of Ordinance No. 78, 1989, Zoning Approximately 5.47 Acres, Known as the Fort Collins Substation Annexation, Into the R-F, Foothills Residential, Zoning District. On May 2, Council unanimously adopted Resolution 89-96 Setting Forth Findings of Fact and Determinations and unanimously adopted on First Reading Ordinance No. 77, 1989 and Ordinance No. 78, 1989. The ordinances annex and zone approximately 5.47 acres located west of Overland Trail and south of West Mulberry Street (extended). The requested zoning is the R-F, Foothills Residential District. The property is presently developed as an electric utility substation for the City of Fort Collins Light & Power Department. The property is currently zoned FA-1, Farming in the County. This is a voluntary annexation. T; RECOMMENDATION: Staff recommends approval of the annexation and zoning request. The Planning and Zoning Board voted 6-0 to recommend approval of the annexation and requested zoning. Hearing and First Reading of Ordinance No. 78 , 1989, Zoning Approximately 5.47 Acres, Known as the Fort Collins Substation Annexation, Into the R-F, Foothills Residential, Zoning District. This is a request to annex and zone approximately 5.47 acres located west of Overland Trail and south of West Mulberry Street (extended). The requested zoning is the R-F, Foothills Residential District. The property is presently developed as an electric utility substation for the City of Fort Collins Light & Power Department. APPLICANT: City of Fort )llins OWNER: Same DATE: May 4, 1989 j -2- i ITEM NUMBER: 8 BACKGROUND: The applicant and owner, the City of Fort Collins, has requested annexation of approximately 5.47 acres located west of Overland Trail and south of West Mulberry Street (extended). The requested zoning is the R-F, Foothills Residential District. The property is presently developed as an electric utility substation for the City of Fort Collins Light & Power Department. The property is currently zoned FA-1, Farming in the County. This is a voluntary annexation. The r:operty is located within the Fort Collins Urban Growth Area. According to policies and agreements between the City of Fort Collins and Larimer County contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA, the City will annex property in the UGA when the property is eligible for annexation according to State law. The property gains the required 1/6 contiguity to existing city limits from a common boundary with the Brown's Annexation, the First Locust Grove Annexation, the Overland Trail Annexation and the Noel Annexation to the southeast. The surrounding zoning and existing land uses are as follows: N: FA-1, Farming, residential development. E: FA-1, Farming, residential development. S: FA-1, Farming, residential development. W: FA-1, Farming, residential development. The requested zoning for this annexation is the R-F, Foothills Residential District. The R-F District designation is for areas near the foothills. The property is develop as a electric utility substation for the City's Light & Power Department. Utility sub -stations are a "use -by -right" in the R-F Zone. There are no immediate redevelopment plans for the property. Findings The annexation of this area is consistent with the policies and agreements between Larimer County and the City of Fort Collins contained in the INTERGOVERNMENTAL AGREEMENT FOR THE FORT COLLINS URBAN GROWTH AREA. The area meets all criteria included in State law to qualify for a voluntary annexation to the City of Fort Collins. On March 21, 1989, the City Council approved a resolution determining that the annexation is in compliance with State law. The resolution also initiated the annexation process for this property by establishing the date, time and place when a public hearing will be held regarding the readings of the Ordinances annexing and zoning the area. 4.
