RECOMMENDATION: Staff recommends adoption of this Ordinance on First Reading. The Planning and Zoning Board voted 7-0 to recommend approval of the rezoning. EXECUTIVE SUMMARY: This is a request to rezone approximately 80.1 acres, located south of Harmony Road and east of Timberline Road, from the T-Transition District to the R-L-P, Low Density Planned Residential, District. Box 16383 Denver, CO 80216 BACKGROUND: The applicant, Geneva Homes, Inc., on behalf of the property owners, Richard J. and Thomas J. Morroni, Catherine C. Gutru, The St. Stephen Foundation (a Colorado not for profit organization), and The St. Christopher Foundation (a Colorado not for profit organization), has submitted a written petition requesting the rezoning of approximately 80.1 acres, located south of Harmony Road and east of Timberline Road, from the T-Transition District to the R-L-P, Low Density Planned Residential, District. The property is presently undeveloped. The property was annexed into the City as part of the South Harmony Annexation in 1985, and placed in the T-Transition Zoning District at that time. The T Zone is for properties which are in a transitional stage with regard to ultimate development. No uses are allowed within the T Zone except the uses which existed DATE: October 5, 1993 I 2 ITEM NUMBER: 12 on the property at the time the property was placed into the T Zone. In order for development to occur on a property in the T Zone, the property must be rezoned to a district which allows development. The City must remove a property from the T Zone and place it into another zoning district within sixty (60) days from the date the matter is considered by the Planning and Zoning Board. The surrounding zoning and existing land uses are as follows: N: EP, Employment Park, mixed use PUD containing the south campus of the hospital and a junior high school E: County FA-1, Farming, undeveloped S: County FA-1, Farming, large lot single-family residential W: T-Transition, undeveloped The requested zoning for the property is the R-L-P, Low Density Planned Residential District. The R-L-P District designation is for areas planned as a unit to provide variation in use, density and building placement. The property will probably eventually develop with a mix of housing types and densities. The property is to be part of an area Overall Development Plan (ODP) called Brookside Village at Rock Creek PUD. STAFF RECOMMENDATION: Staff recommends approval of the requested rezoning with a PUD condition. A PUD condition requires all development proposals on the property to be processed as a planned unit development and reviewed against the criteria of the Land Development Guidance System. PLANNING AND ZONING BOARD RECOMMENDATION: The Planning and Zoning Board, at its regular monthly meeting of September 27, 1993, voted 7-0 to approved the requested rezoning as part of the Board's Consent Agenda. . ORDINANCE NO. 110, 1993 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING THE ZONING DISTRICT MAP OF THE CITY OF FORT COLLINS BY CHANGING THE ZONING CLASSIFICATION FOR THAT CERTAIN PROPERTY KNOWN AS THE BROOKSIDE VILLAGE AT ROCK CREEK PUD REZONING BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That the Zoning District Map adopted by Chapter 29 of the Code of the City of Fort Collins be, and the same hereby is, amended by changing the zoning classification from "T," Transition Zoning District, to "R-L-P," Low Density Planned Residential Zoning District, for the following described property in the City known as the Brookside Village at Rock Creek PUD Rezoning: The North half of the Southwest Quarter of Section 5, Township 6 North, Range 68 West of the 6th Principal Meridian, City of Fort Collins, Larimer County, State of Colorado. Section 2. That the zoning granted herein is expressly conditioned upon the entire above -described property being developed as a planned unit development in accordance with the ordinances of the City. Section 3. That the Sign District Map adopted pursuant to Section 29-593.1 of the Code of the City of Fort Collins be, and the same hereby is, changed and amended by showing that the above -described property is included in the Residential Neighborhood Sign District. Section 4. The City Engineer is hereby authorized and directed to amend said Zoning District Map in accordance with this Ordinance.
