05/17/2021: INFORMATION:
LUC 2.211 Lapse, Term of Vested Right: Within a maximum of three (3) years
following the approval of a final plan or other site specific development plan, the
applicant must undertake, install and complete all engineering improvements
(water, sewer, streets, curb, gutter, street lights, fire hydrants and storm
drainage) in accordance with city codes, rules and regulations. The period of
time shall constitute the "term of the vested property right." Failure to undertake
and complete such engineering improvements within the term of the vested
property right shall cause a forfeiture of the vested property right and shall
require resubmission of all materials and reapproval of the same to be
processed as required by this Code. All dedications as contained on the final

The City has had some coordination on being able to collect this fee. I should
be able to give you a final number prior to your DCP issuance. If you are ready
to move forward with construction prior to this being provided, we will have
some flexibility to allow you to begin construction prior to paying it, if absolutely
necessary, so this should not hold up your construction schedule. DCI Response: Noted
04/06/2021: FOR FINAL APPROVAL:
This comment is just a reminder that there is a repayment due to the City of Fort
Collins for previously constructed I-25/Hwy 392 interchange improvements. I
believe I provided an estimated cost of the repay in a previous comment or

I am continuing to work with City staff on finalizing the DA draft. Once our City

04/06/2021: DEVELOPMENT AGREEMENT:
A development agreement (DA) will be required for this project. Please
complete and submit a development agreement information form (included in
the comments/redlines for this submittal). I will need this in order to prepare the
draft agreement. I will try and get a draft DA ready for review by our City

Attorney by the time we issue comments on your next submittal. Once our
attorney has reviewed the agreement, the draft will be provided to you for

I understand that construction may be planned to begin later this year. Please
continue to keep me in the loop regarding your construction schedule and when
you will be looking to have the DCP meeting, which is required prior to DCP
issuance. I have sent the cost estimate and utility plans to our Chief
Engineering Inspector for review. I will follow up once I have received either

05/24/2021: DEVELOPMENT CONSTRUCTION PERMIT
Thank you for submitting the cost estimate and DCP application form. Once
staff feels that the site layout/design will not significantly change, the estimate

04/06/2021: DEVELOPMENT CONSTRUCTION PERMIT:
A development construction permit (DCP) will be required prior to commencing
construction of any public improvements. Once the plans are close to approval,
we will need an engineer's opinion of cost submitted by the consulting engineer
(licensed in CO). This cost estimate will be reviewed by Engineering and
Engineering Inspections staff. Once approved, it will serve as the basis for
Engineering inspection fees as well as public improvement surety that will be

Thank you for submitting the easement documents for review. Please continue
to work with me to get the easements approved and then recorded. Please
note that the developer will need to pay the appropriate recording fees to
Larimer County in order to record all documents. Once the easement
documents are finalized, the City will provide you with the final amount of the

There are going to be quite a few easement dedications and vacations for this
site. They will need to be processed by separate instrument, which will require
legal descriptions and exhibits for each, as well as deeds of dedication or
vacation resolutions. We will want to see the survey documents as soon as
possible once the site, utilities, etc. are pretty well set and not going to change.
You will need to submit a completed TDRF application and fees for the
easements ($250/dedication and $400/vacation). There is more information as
well as template deeds of dedication on our website: City Development Review

note that this comment only applies to easements to be dedicated to the City of

Fort Collins or City easements being vacated. Easements dedicated to or
being vacated that are owned by another municipality would be handled per that
entity's standards and coordinated with them. We would just need the
documentation (reception #) for those dedications/vacations to be shown on the plans.

04/01/2021: INFORMATION ONLY:
The City Manager’s development review fee schedule under City Code 7.5-2
was updated to include fees for Erosion Control and Stormwater Inspections.
As of January 1st, 2021, these fees will be collected on all projects for such
inspections.
The Erosion Control fees are based on; the number of lots, the total site
disturbance and the estimated number of years the project will be active; the
Stormwater Inspection Fees are based on the number of LID/WQ Features that
are designed for on this project. Based on the proposed site construction
associated with this project we are assuming 1 lot, 2.89 acres of disturbance, 1
year from demo through build out of construction and an additional 3 years till full
vegetative stabilization due to seeding. Which results in an Erosion Control Fee
estimate of $ 1,172.09
Based on 1 extended detention and 2 sand filters/underground treatments, the
estimate of the Stormwater LID/WQ Inspection fee to is $ 1,080
Please note that as the plans and any subsequent review modifications of the
above-mentioned values change the fees may need to be modified. I have
provided a copy of the spreadsheet used to arrive at these estimates for your
review. Maverik Response: The fees will be coordinated with Brandy and paid at the requested time.

05/24/2021: Thank you for reaching out, meeting, and coordinating on these
latest updates and addressing many of my concerns. While many have been
addressed, there are still some questions remaining regarding the outlet
structure, spillway, hydraulic sizing, and other details. Please see updated
redlines for reference, and I encourage another meeting to review redlines and

assure proper response.
