RECOMMENDATION: Staff recommends adoption of the Ordinance on First Reading. EXECUTIVE SUMMARY: This is a request to rezone approximately 151.1 acres, located at the southeast corner of Harmony Road and Timberline Road into the I-P Industrial Park Zoning District, with a planned unit development condition. The property is presently in the T-Transition Zoning District. APPLICANT: Everitt Enterprises, Ltd. OWNER: Elmer and Betty Stromberger P. 0. Box 2125 2209 East Harmony Road Fort Collins, CO 80522 Fort Collins, CO 80525 BACKGROUND: Everitt Enterprises, Ltd. is requesting rezoning of approximately 151.1 acres, located at the southeast corner of Harmony Road and Timberline Road from the T-Transition Zoning District into the I-P Industrial Park Zoning District, with a planned unit development condition. The property is presently in agricultural use and contains two residences. This site was annexed into the City in 1986 as the South Harmony Annexation and was zoned T-Transition. The T-Transition Zoning District was developed to allow for properties to be annexed into the City and meet state statutes to be zoned within 90 days of annexation, without the property owner making a commitment for ultimate development. The only uses allowed on property zoned T-Transition are those uses which existed on the property at the time the zone was placed on the property. Properties in the Transition Zone must be zoned into one or more of the City's other zoning districts within 60 days of the rezoning request being heard by the Planning and Zoning Board. The applicant has requested I-P Industrial Park Zoning for this site, with a planned unit development condition. The Industrial Park designation is for light industrial park areas containing controlled industrial uses in proximity to areas zoned for residential use and along arterial streets. DATE: May 16, 198S _2_ _ I ITEM NUMBER:27 Given the property's location adjacent to Harmony Road and Timberline Road, the eventual development of industrial land uses is probable. The PUD condition would require development projects to be reviewed under the criteria contained in the Land Development Guidance System. According to the City's Land Use Policies Plan, industrial uses should locate near transportation facilities that offer adequate access without creating demands which exceed the capacity of the existing transportation network and in areas where adequate utilities can be provided. This site addresses these locational policies and the proposed zoning is consistent with the existing zoning in the area. At its regular monthly meeting on April 26, 1989, the Planning and Zoning Board voted 4-0 to recommend approval of the requested rezoning as part of its Consent Agenda. C` • ORDINANCE NO. 90, 1989 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING THE ZONING ORDINANCE OF THE CITY OF FORT COLLINS, BY CHANGING THE ZONING CLASSIFICATION FOR CERTAIN PROPERTY KNOWN AS THE STROMBERGER REZONING BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That the Zoning District Map adopted by Chapter 29 of the Code of the City of Fort Collins be, and the same hereby is, amended by changing the zoning classification from T Transition District to I-P Industrial Park District, for the following described property in the City known as the Stromberger Rezoning: A tract of land located in the Northwest Quarter of Section 5, Township 6 North, Range 68 West of the 6th Principal Meridian, City of Fort Collins, Larimer County, Colorado, and being more particularly described as follows: Considering the North line of the Northwest Quarter of said Section 5 as bearing S 89°22'37" E from a No. 4 rebar at the Northwest Corner of said Section 5 to a 3/4" iron pipe at the North Quarter Corner of said Section 5 and with all bearings contained herein relative thereto: Commencing at the Northwest Corner of said Section 5; thence along the West line of said Northwest Quarter, S 0009'20" E 170.00 feet to the Southerly right-of-way of Colorado State Highway No. 68 (Harmony Road), said point being the POINT OF BEGINNING; thence along said Southerly right-of-way the following 3 courses and distances: S 89°22'37" E 30.00 feet; thence N 45°14'38" E 70.20 feet; thence S 89°22'37" E 2570.48 feet to a point on the East line of said Northwest Quarter of Section 5; thence along said East line S 0°46'37" E 2464.09 feet to the Southeast corner of said Northwest Quarter; thence along the South line of the said Northwest Quarter N 89°44'30" W 2677.01 feet to the Southwest Corner of said Northwest Quarter; thence along the West line of said Northwest Quarter N 0°09'20" W 2430.65 feet to the Point of Beginning. The above described tract of land contains 151.102 acres. Section 2. That the rezoning granted herein is expressly conditioned upon the entire above -described property being developed as a planned unit development in accordance with the Code of the City of Fort Collins. Section 3. The City Engineer is hereby authorized and directed to amend said Zoning District Map in accordance with this Ordinance.
