It should be noted that the pavement design report required during the course of construction of the development would further look at on-site conditions to evaluate how to ensure structural 2 integrity of the road is addressed. JR Response: Noted Comment Number: 10 Comment Originated: 02/15/2021 02/15/2021: information only: The City had a discussion with Xcel to understand their thoughts with their existing facility in the existing Public Service Easement and how the development would impact this. Xcel is OK with the project going to a public hearing, but would need to work out with the applicant on how their existing easement will be vacated & rededicated and the utility relocated accordingly. Note that there is an existing 12' utility, access, and drainage easement directly north that would appear to be a physical location, however the easement is a private easement not dedicated to the City and the City would not claim that Xcel has a right to relocate in that existing private easement as a result. JR Response: Worked offline with Xcel. They are okay with relocating the existing gas line north within their existing easement. A 16’ utility, access, emergency access, and drainage easement is being provided. Note that in addition to the 12' easement along the northern boundary being private, the "temporary access utility and drainage easement" identified to be vacated by separate document is also private. It does not appear this can be vacated by separate document without the consent of the grantee of the easement and if it appears that is the intention of the applicant to have this vacated prior to the approval of the plat, an agreement would appear to be needed. Note that the easement language appears to allow the easement to automatically terminate upon the construction of Snead Drive. It is suggested (if not already done) that the applicant consider legal counsel on how to represent this easement's status on the plat. The applicant is reminded that approval of FDP will require: > Written letter proposing Alternative Means & Methods for out-of-access condition for a fire access lane on the north side of building at 23 feet in width when 26 feet is the minimum required for aerial fire apparatus access. > The Site Plan and DA agreement shall prohibit fencing on the north side of the property so as to maintain access for aerial fire apparatus. > The Landscape Plan and DA agreement prohibits the placement of trees or other vertical vegetation on the north side of the property so as to maintain access for aerial fire apparatus. > Location of fire lane no parking signage is required on final plans. No parking signs added to final plans Comment Number: 2 Comment Originated: 02/09/2021 02/09/2021: BUILDINGS FOUR OR MORE STORIES As the building department has determined this structure to be a four-story building, the following comments shall apply: > ROOF ACCESS: New buildings four or more stories above grade plane shall be provided with a stairway to the roof. Stairway access to the roof shall be in accordance with IFC 1011.12. Such stairways shall be marked at street and floor levels with a sign indicating that the stairway continues to the roof. Where roofs are used for roof gardens or for other purposes, stairways shall be provided as required for such occupancy classification (IFC 504.3). > FIRE STANDPIPE SYSTEM: Standpipe systems shall be provided in new buildings and structures in accordance with Section 905 of the 2018 International Fire Code. Approved standpipe systems shall be installed throughout buildings where the floor level of the highest story is located more 8 than 30 feet above the lowest level of fire department vehicle access. The standpipe system shall be capable of supplying a minimum of 100 psi to the top habitable floor. An approved fire pump may be required to achieve this minimum pressure. Buildings equipped with standpipes are required to have a hydrant within 100 feet of the Fire Department Connection (IFC Sections 905 and 913). > HYDRANT FOR STANDPIPE SYSTEMS: Buildings equipped with a standpipe system installed in accordance with Section 905 shall have a fire hydrant capable of providing 1500 gpm at 20 psi residual pressure, located within 100 feet of the fire department connections. Exception: The distance shall be permitted to exceed 100 feet where approved by the fire code official (IFC 507.5.1.1). > Any of the above comments (now required) that were previously proposed to offset the lack of aerial fire apparatus access are no longer eligible as an offsetting measure.
