Dear Mr. Rose:
This letter is to state that the development project known as The Market Place
P.U.D., Phase One, Final, (Planning Department Project #21-89A), has received final
approval from the Fort Collins Planning and Zoning Board on June 26, 1989. As you
are aware, however, this approval was conditioned upon the provision that the
applicant provide satisfactory evidence that any lien or encumbrance holders with
any beneficial interest in any portion of the platted property, and who have not
signed the plat, or otherwise duly and lawfully consented to the development of the
property in accordance with the plat and other development documents, have first
released and surrendered any such beneficial interest.
After examining the correspondence between Mr. Lance P. Vanzant, Esq., the certify-
ing attorney on the plat document, and Mr. Paul Eckman, Deputy City Attorney, the
Planning Department does hereby acknowledge that the satisfactory evidence required
in the Planning and Zoning Board's condition of approval has indeed been presented
and found acceptable. With this condition now satisfied, the Market Place P.U.D.,
Phase One, Final, now meets criteria of the Land Development Guidance System
(Section 29-526 of the City Code) for a final P.U.D. plan.
The Market Place P.U.D., Phase One Final is now eligible to be submitted to the
Building Inspection Division of the Department of Development Services for building
permit application and review.
Enclosed for your records please find a copy of the Planning and Zoning Board
condition of approval, and two letters, dated June 26, 1989 and June 28, 1989 from
Mr. Lance P. Vanzant, Esq. to Paul Eckman, Deputy City Attorney.
