We are presently in the process of reviewing the final plan
submittal for Laurie Subdivision PUD. The proposed plan, as
enclosed, references a 12' wide easement for your irrigation
channel. Based on your previous comments, I understand that the
association is requesting a 20' wide easement.
The City of Fort Collins can and does require that irrigation
companies sign their approval on final utility plans. When this
happens, the developer must essentially negotiate with the
irrigation company a solution that is acceptable to the irrigation
company in order to obtain a signature. In this particular
instance, we are unsure of the status of the Applewood Water
Association and whether the association qualifies as an irrigation
"company". Thus, any documentation (ie. articles of incorporation,
etc.) that you may provide for us to use in determining whether the
Applewood Irrigation Association is considered an irrigation
company would be very useful as part of our final review process.
