Thank you! 2 Comment Number: 2 Comment Number: 5 04/06/2021: INFORMATION: Temporary Service Changes - City of Fort Collins Development Review In order to continue providing thorough reviews and giving every project the attention it deserves, the City of Fort Collins is implementing temporary changes in how we serve our development customers. As you may be aware, we are experiencing staff shortages in a number of key departments, which has begun to impact the quality and timeliness of our reviews. We recognize that development and construction play a critical role in our community’s vibrancy and economic recovery, and we have been exploring options for mitigating impacts to our customers. As a result, we will be making some temporary service changes. Beginning Monday May 10th one additional week of review time will be added to all 1st and 2nd round submittals (increase from 3 weeks to 4 weeks). DCI Response: Noted Comment Number: 5 05/17/2021: INFORMATION: LUC 2.211 Lapse, Term of Vested Right: Within a maximum of three (3) years following the approval of a final plan or other site specific development plan, the applicant must undertake, install and complete all engineering improvements (water, sewer, streets, curb, gutter, street lights, fire hydrants and storm drainage) in accordance with city codes, rules and regulations. The period of time shall constitute the "term of the vested property right." Failure to undertake and complete such engineering improvements within the term of the vested property right shall cause a forfeiture of the vested property right and shall require resubmission of all materials and reapproval of the same to be processed as required by this Code. All dedications as contained on the final plat shall remain valid unless vacated in accordance with law. A draft of the agreement will be prepared by City staff and provided for review by the owner/developer. 04/06/2021: DEVELOPMENT AGREEMENT: A development agreement (DA) will be required for this project. Please complete and submit a development agreement information form (included in the comments/redlines for this submittal). I will need this in order to prepare the draft agreement. I will try and get a draft DA ready for review by our City Attorney by the time we issue comments on your next submittal. 3 Once our attorney has reviewed the agreement, the draft will be provided to you for review. The DA will need to be completed prior to final approval. Once staff feels that the site layout/design will not significantly change, the estimate will be sent to the Chief Engineering Inspector for review. 04/06/2021: DEVELOPMENT CONSTRUCTION PERMIT: A development construction permit (DCP) will be required prior to commencing construction of any public improvements. Once the plans are close to approval, we will need an engineer's opinion of cost submitted by the consulting engineer (licensed in CO). This cost estimate will be reviewed by Engineering and Engineering Inspections staff. Once approved, it will serve as the basis for Engineering inspection fees as well as public improvement surety that will be required prior to DCP issuance. Please note that the developer will need to pay the appropriate recording fees to Larimer County in order to record all documents. Once the easement documents are finalized, the City will provide you with the final amount of the recording fees. While many have been addressed, there are still some questions remaining regarding the outlet structure, spillway, hydraulic sizing, and other details. Please see updated redlines for reference, and I encourage another meeting to review redlines and potential revisions. Please refer to the redlines for detailed responses regarding the outlet structure, spillway, hydraulic sizing, etc. 04/05/2021: There are numerous redlines from preliminary review that have not been addressed including details on the spill containment system, the sand filters and forebays. Please review current redlines, and provide written responses on the 4 PDFs. Comment to remain active to ensure easement is dedicated prior to final project approval. 04/05/2021: Please clarify proposed drainage easements areas to include all sand filters, detention pond, and outfall. Please provide easement dedication or plat for review. DCI Response: The drainage easement is currently submitted by separate document. The easement exhibit included in the plan set has been revised so the boundary of the easement clearly shows all drainage facilities do lie within this easement such as the three sand filters and detention pond. The payment-in-lieu is due prior to issuance of the DCP, and the fee and payment mechanism is required to be recorded in the Development 5 Agreement. DCI Response: Please see detailed responses in the redlines 04/01/2021: INFORMATION ONLY: The City Manager’s development review fee schedule under City Code 7.5-2 was updated to include fees for Erosion Control and Stormwater Inspections. As of January 1st, 2021, these fees will be collected on all projects for such inspections. The Erosion Control fees are based on; the number of lots, the total site disturbance and the estimated number of years the project will be active; the Stormwater Inspection Fees are based on the number of LID/WQ Features that are designed for on this project. Based on the proposed site construction associated with this project we are assuming 1 lot, 2.89 acres of disturbance, 1 year from demo through build out of construction and an additional 3 years till full vegetative stabilization due to seeding. Which results in an Erosion Control Fee estimate of $ 6 1,172.09 Based on 1 extended detention and 2 sand filters/underground treatments, the estimate of the Stormwater LID/WQ Inspection fee to is $ 1,080 Please note that as the plans and any subsequent review modifications of the above- mentioned values change the fees may need to be modified. I have provided a copy of the spreadsheet used to arrive at these estimates for your review.
