This ditch supplies water to the Applewood Estates subdivision as well as to other irrigators. Your company is doing the engineering and planning for Dr. William Musselwhite, the developer. We have a copy of the Utilities Plan you submitted to the City of Fort Collins Planning and Zoning Board for preliminary approval at its meeting on August 26th. We also have a copy of your Revised Drainage and Erosion Report in which the ditch is discussed. The Utility Plan and Drainage Report proposes replacing our ditch with a 12 foot irrigation ditch (sic) easement and an 18 inch underground pipe. No other details are given. We are not opposed in principal to a pipeline. Sections of our system in the Clarendon Hills and Orchards subdivisions were placed underground during development, and we understand the desire of Dr. Musselwhite to eliminate the ditch. However, we are very concerned about the location, design and installation of the pipeline and its compatibility with the rest of our system, which we expect will be completely underground at some point. In the past the H&S Irrigation company in Greeley designed and installed our underground pipeline. During our conversation I suggested having H&S involved in the design of the Laurie pipeline. You ignored my suggestion, requesting only the flow rate of the ditch. However, there are many factors other than flow rate to take into account. While we cannot stop Dr. Musselwhite from submitting plans without our input, we will not approve any plans for a pipeline until our consultant approves its location, design and installation. We would expect Dr. Musselwhite to pay the consulting fees. Moreover, we wish to make it clear that if Dr. Musselwhite attempts to obtain City approval for a pipeline without our agreement, we will take whatever legal action is necessary to prevent elimination of our ditch. This ditch is fully protected by an easement which has been in existence for over one hundred years. You should also be aware that Applewood is not the only irrigator involved. There are several individuals to the east of the Orchards subdivision whose approval must be sought. Based on our previous experience we expect one objection to the plans submitted so far will be the width of the proposed easement. We will probably require a 20 foot easement, which is consistent with our pipeline easements elsewhere. We wish to point out, however, that we will not approve parts of a plan on a piecemeal basis. All of the details of the pipeline must be negotiated as a package before we approve any plans, preliminary or final. Finally, your Drainage Report is inaccurate in stating that " [fI low rates provided by the Applewood Estates Irrigation Company (sic) indicated a maximum flow rate of 2.5 cfs." I was the only Applewood representative you talked to, and I was unable to give you any flow rates. What I told you was that I thought our main underground pipe was 18 inches in diameter but that I would have to verify it. Our consultant will be able to provide that information.
