Dear Mr, and Mrs. Joy,
As you know, on August 2,
1989, the
Larimer County
Board of Commissioners
approved
your request for
a Minor
Land Division
(MLD)
for a property
located on East Mulberry
Street in
the northwest
quarter
of Section 18,
Township
7 north, Range 68 west of
the 6th P.M.
One of
the conditions
placed on
the approval of the MLD by
the County was
that the
property would
annex into
the City of Fort
Collins.
While you did submit a Petition for Annexation of the property, upon fur-
ther processing of the petition by City staff a problem was identified that
must be corrected.
In processing
the Petition
for Annexation, City staff investigated
the own-
ership of the property in
question. The Petition for Annexation
normally
contains an
attorney certification
as to the ownership (your
petition
lacked this
certification).
City staff has discovered that the
Larimer
County Records reflect that the property is presently under the
ownership
of Arthur T.
and Dianna L.
Chacon.
The Chacons took title to the property pursuant to a deed recorded in Book
1844 at Page 914 of the Larimer County Records, recorded on March 29, 1978.
There is a document recorded at Reception No. 89034614, recorded on August
4, 1989, where you have indemnified Larimer County against certain damages
and wherein you represented yourselves to be the record owners of 1201 "A"
East Mulberry Street. However, City staff has not been able to find any
conveyance of property to you that appears in the Larimer County Records.
Has a deed been recorded that we are missing? If so, could you provide us
with a copy of the recorded deed or at least a reception number under which
we may obtain a copy? It may be that there is an error in recording or in
some other way we are not able to find the deed.
