Modification request to the standard is provided with this re-submittal Comment Number: 8 Comment Originated: 08/10/2020 08/10/2020: FOR HEARING: Per LUC Sec. 3.5.3(E) Character and Image: “(1) Building design shall contribute to the uniqueness of a zone district, and/or the Fort Collins community with predominant materials, elements, features, color range and activity areas tailored specifically to the site and its context… A standardized prototype design shall be modified as necessary to comply with the requirements of this subsection.” The existing design needs additional refinement to ensure that it meets the minimum standards if this subsection. Specifically, the treatment of the façade, entrances, awnings, and the base and top treatments are all lacking in architectural interest. Additionally, a materials legend and/or palette should be provided with the next submittal that better illustrates the materials being proposed, the colors, etc. of the structure. R. The building elevations have been enhanced. Material and color selections will be provided prior to hearing.. Comment Number: 9 Comment Originated: 08/10/2020 08/10/2020: FOR HEARING: Full tree stocking on this site is required per Sec. 3.2.1(D)(1) (c): "(c) "full tree stocking" shall be required in all landscape areas within fifty (50) feet of any building or structure as further described below. Landscape areas shall be provided in adequate numbers, locations, and dimensions to allow full tree stocking to occur along all high use or high visibility sides of any building or structure. Such landscape areas shall extend at least seven (7) feet from any building or structure wall and contain at least fifty-five (55) square feet of nonpaved ground area, except that any planting cutouts in walkways shall contain at least sixteen (16) square feet. Planting cutouts, planters or other landscape areas for tree planting shall be provided within any walkway that is twelve (12) feet or greater in width adjoining a vehicle use area that is not covered with an overhead fixture or canopy that would prevent growth and maturity. Full tree stocking shall mean formal or informal groupings of trees planted according to the following spacing dimensions: Tree Type Minimum/Maximum Spacing Canopy shade Trees 30'-40' Coniferous evergreens 20'-30' Ornamental trees 20'-30' Exact locations and spacings may be adjusted at the option of the applicant to support patterns of use, views and circulation as long as the minimum tree planting requirement is met. Canopy shade trees shall constitute at least fifty (50) percent of all tree plantings. Trees required in subparagraphs (a) or (b) above may be used to contribute to this standard." R. Could you confirm that and provide details as to the daily staffing and number of students, along with days of operation? While it is unlikely this additional traffic will exceed the threshold of requiring a full Traffic Impact Study, we will need to document all the daily trips that will be generated in order to make this determination. R. We are not sure where the pre-school idea came from but this project will not be proposing a pre-school operation. Unless designated as a Group-U Occupancy (eg. barn or agricultural support building), the fire access plan will need to be revised so as to bring this building into compliance. R. The Fire Lane has been revised to meet Poudre Fire Authority truck template movements and e-mail directives and was approved in your Tuesday, September 22, 2020 e-mail. Comment Number: 2 Comment Originated: 08/07/2020 08/07/2020: FOR HEARING OCCUPANCY GROUP CLASSIFICATION - Expanding on the last comment, the occupancy classification of the existing building on the NE corner of the site shall be determined by the Building Department; however, from the project narrative the building appears it will be used as a Group A or E occupancy with youth activities (or day care?). Please be aware that based upon that information, not only will the fire lane need to be extended, other fire code requirements shall apply to the assigned occupancy. For example, more than one exit is required with an occupant load greater then 49 and a fire sprinkler requirement will apply to a Group-A with an occupant load of 100 or more. More information is required in order to detail code specific requirements. R. The existing building was determined to be occupancy group classification B. Several exits are provided. The location of fire service lines and FDC(s) shall be approved by the fire department and the location labeled on Utility Plans. R. The Fire Department Connection (FDC) is located on the street side of building and labeled on the Utility Plans. > KEY BOXES REQUIRED - Poudre Fire Authority requires at least one key box ("Knox Box") to be mounted in an approved, exterior location on every new or existing building equipped with a required fire sprinkler or fire alarm system. The City would like the development team to explore additional design options to achieve the full LID requirement. R. Our opinion is that the LID provided is more than enough considering the site location relative to the length of the outfall path through undeveloped ground and an existing sump condition to the east of the site. Refer to the Offsite historic drainage exhibit attached. We respectfully request that our variance request be granted. Comment Number: 4 Comment Originated: 08/10/2020 08/10/2020: A sand filter was proposed as the LID technique, however the bioretention LID option may be better suited in this specific case. Generally, the sand filter is used when horizontal space is limited, and vertical depth is more available. In this case, vertical depth is limited due to the higher outfall. Bioretention can have a ponding depth of up to 1 foot, where sand filters can be designed with 3 feet of ponding depth. R. The problem with both LID devices is the required depth of the filter media, not the ponding depth. The Bio-Retention LID does not help this situation because the filter media depth is even greater than the Sand Filter media depth. Comment Number: 5 Comment Originated: 08/10/2020 08/10/2020: This site is required to treat 75% of it's impervious area using a LID technique if porous pavers are not being proposed. In the Drainage Report, it states the intent was to design only for 50%. Please revise. R. The drainage report is addressing the criterion set for this project by Heather McDowell in her original comments (shown below) that 50% of the site runoff must be treated using standard water quality treatment. This is separate from the LID 75% treatment requirement. The drainage report goes on to discuss the vertical geometry difficulties encountered when trying to accommodate the LID 75% treatment volume. The report states to offset this shortage, the standard water quality design goes beyond the project 50% requirement and treats 100% of the site runoff in the detention pond with Extended Detention. Heather McDowell Comment: “..Fifty percent of the site runoff is required to be treated using the standard water quality treatment as described in the Fort Collins Stormwater Manual, Volume 3-Best Management Practices (BMPs).(http://www.fcgov.com/utilities/business/builders-and-developers/development-forms-guidelines- regulations/stormwater-criteria) Extended detention is the usual method selected for water quality treatment; however the use of any of the BMPs is encouraged…” Page 8 of 14 Comment Number: 6 Comment Originated: 08/10/2020 08/10/2020: A letter of intent is required for the off-site drainage easement that is needed to release the drainage to the historic outfall to the east. R. We are still working with George Holter on the detention pond outfall drainage path. We have met Mr. Holter’s conditions to release to the historic path that directs runoff to the Lateral 10 ditch and to the farm to the south. We have the letter of intent drafted and have provided to Mr. Holter. We have not received a signed copy back yet but will provide to you as soon as we receive it. A copy of that letter of intent is attached for immediate reference. Comment Number: 7 Comment Originated: 08/10/2020 08/10/2020: The proposed outfall has to be proven no negative impacts will occur to downstream properties. The outfall needs to be investigated down to a public drainage facility to determine if the outfall is adequate. R. All runoff from the Voice of Truth Tabernacle Subdivision has been historically directed east to the east end of Outlot A of the Dix Amended Plat. There is an existing sump condition at the east end of Outlot A of the Dix Amended Plat. From the existing sump condition, runoff travels Southeasterly to the Lateral 10 ditch, then south through the existing farm south of the Lateral 10 ditch. All property east of the Voice of Truth Subdivision between North Timberline Road and the existing Burlington Northern Railroad is currently undeveloped. The remaining runoff to east that is not intercepted by the Lateral 10 ditch continues southeasterly to a 33"x26" CMP Arch culvert. Runoff then turns south through Buderus Exemption and under Vine Drive through a 24" diameter CMP culvert to the south side of Old Vine Drive. All land between the Voice of Truth Subdivision and the outfalls discussed are currently undeveloped. There will be no negative impacts on downstream properties. Refer to historic drainage exhibit included with this response to comments letter. These were not inventoried during the original Forestry site visit. If there is a chance that these trees may be impacted by grading or other site work, please schedule a follow-up site visit with City Forestry to obtain inventory and mitigation information. Page 11 of 14 R. There is one tree on lot 2 that will be protected and saved, per City Tree Protection Notes, when trees on the front of that lot are removed for grading and utilities. Comment Number: 12 Comment Originated: 08/11/2020 8/11/2020: FOR HEARING Please provide an “Existing Tree Removal Feasibility Letter” for City Forestry staff to review. Proposals to remove significant existing trees must provide a justification letter detailing the reason for tree removal. This is required for all development projects proposing significant tree removal regardless of the scale of the project. The purpose of this letter is to provide a document of record with the project’s approval and for the City to maintain a record of all proposed significant tree removals and justifications. Existing significant trees within the project’s Limits of Disturbance (LOD) and within natural area buffer zones shall be preserved to the extent reasonably feasible. Streets, buildings and lot layouts shall be designed to minimize the disturbance to significant existing trees. (Extent reasonably feasible shall mean that, under the circumstances, reasonable efforts have been undertaken to comply with the regulation, that the costs of compliance clearly outweigh the potential benefits to the public or would unreasonably burden the proposed project, and reasonable steps have been undertaken to minimize any potential harm or adverse impacts resulting from noncompliance with the regulation.) Where it is not feasible to protect and retain significant existing tree(s) or to transplant them to another on-site location, the applicant shall replace such tree(s) according to City mitigation requirements. Page 8 Erosion Control Report Voice of Truth Tabernacle Subdivision; Fort Collins, Colorado To prevent slurry from discharging offsite, contractors will use the minimum amount of water needed to prevent dust and blades from overheating. Cutting slurry will be collected via vacuum or allowed to dry out and be scraped and swept up after the cutting has finished (saw cutting). o. Ground Water Dewatering – No – Based upon the geotechnical data, ground water was not encountered 5'-15' below existing grade. However, if encountered, dewatering activities may be required. Groundwater has in most excavations mixed with the dirt and as they are pumped, they will add an increased velocity coming out of the out- flow end contributing to erosion and speeding the transport of the suspended sediment particles. Also, construction dewatering activities must be identified in the Erosion Control Report if they are to be infiltrated on site. If the material is anticipated to be pumped to a stormwater conveyance the proper Construction Dewatering Permit must be pulled from the State of Colorado. If pumping activities are to occur on the site, the use of rock packs on the intake end of the pump will be used and a silt bag will be used on the outflow end of the pump to reduce the silt and sediment from leaving the activity. If this will be under a Dewatering Permit water samples will be collected in accordance with that permit. III. INSTALLATION AND REMOVAL SEQUENCE OF CONTROL MEASURES 1. The following temporary BMP’s measures are specified on the Sediment/Erosion Control and Water Quality Plan (Interim). Refer to sequence schedule on this plan for the installation and removal of these control measures. a. Wattles (Site Mobilization – Completion of Landscaping) Wattle installations shall be installed to reduce erosion prior to runoff reaching adjacent undisturbed areas. Wattles shall be installed in general compliance with the installation detail on the Detail Sheet. Wattles shall be inspected and maintained on biweekly basis and within twenty-four (24) hours of a storm event. Vehicle Tracking Pad (Site Mobilization – Completion of Flat work) All vehicle tracking control pads shall be installed prior to any Construction Activity (stockpiling, stripping, grading, etc.) being used during any of the future construction phases. Vehicle tracking control pads are to be installed prior to site excavation or earthwork activities. Tracking pads shall be removed once activities that require going from dirt to hardscape stop on the project. Vehicle tracking control pads shall be installed in general compliance with the installation detail on the Detail Sheet. c. Concrete Washout Area (Concrete Foundation Installations – Completion of Concrete Foundations and Flat work) Washout location is shown on the Sediment/Erosion Control and Water Quality Plan (Interim) and the installation detail is shown on the Detail Sheet. This location is a suggestion and can be relocated at the discretion of the Contractor while keeping it away from drainage courses. d. Rock Sock Protection (Site Mobilization – Completion of Landscaping) Rock Sock Protection installations shall be installed to reduce sediment contribution to adjacent undisturbed areas. Curb Sock installation detail is shown on the Detail Sheet. IV. FINAL VEGETATION AND STABILIZATION AND EROSION CONTROL ESCROW 1. Exposed dirt in areas that contain Hardscapes, Buildings, and Rock bed will be considered to be stabilized immediately upon installation and would prevent future Erosion to those areas. Those areas where sod will be installed as per design, will require soil amending in accordance with §12-132 and irrigated as a permanent feature to the project. Upon installation of those sod areas they will be considered stabilized and will prevent further Erosion to those areas. Those areas would then be under warranty. All areas to be seeded as outlined in the Landscape Plan, or required by the City in the disturbance of other properties, will have the area amended in accordance with §12-132 of City Municipal Code and be seeded based upon the specifications called out in the Landscape Plan. A copy of the Landscape Plan is attached to the report. All seeded areas will be crimped and mulched same day or next day after seeding in accordance with the Temporary and Permanent Seeding Details associated with this project as seen in the appendix, and in accordance with the City of Fort Collins Erosion Control Criteria. Once installed there will be no temporary irrigation system so all seeding will be monitored until the site has reached a vegetative cover (density) of 70%.
