Own the property or an interest in the property described in the deed attached hereto as Exhibit A (the “Property”); and 2.4 Consent to entry upon the Property by City officials for the purpose of inspection, and if necessary, posting of public notice as required for consideration of the Development Review Application by the City. 3. The NISP Enterprise agrees that nothing herein creates any right or entitlement to the use of the Property by the NISP Enterprise or any other party except as specified in subsection 2.4 of this Consent, and further agrees to compensate Owner for any actual damage to the Property that occurs in the course of the actions specified in subsection 4) of the preceding sentence. 1. The Northern Integrated Supply Project Water Activity Enterprise, a government-owned business within the meaning of Article X, §20(2)(d) of the Colorado Constitution, organized pursuant to C.R.S. § 37-42.5-101 et seq., and owned by the Northern Colorado Water Conservancy District (“NISP Enterprise”), will be filing a Development Review Application with the City of Fort Collins for a proposal to construct approximately 3 miles of buried raw water pipeline and a river diversion structure associated with the NISP (“Project”); .
