RECOMMENDATION: Staff recommends adoption of the Resolution. EXECUTIVE SUMMARY: The property being considered for annexation has, for a period of not less than three (3) years, been completely surrounded by property contained within the boundaries of the City of Fort Collins. The property being considered for annexation is approximately 4.2 acres in size and is located north of Harmony Road and west of the Union Pacific railroad tracks. The proposed Resolution determines that it is in the best interest of the citizens of the City to annex the area and that the annexation complies with the Municipal Annexation Act. The Resolution also determines that a hearing should be established regarding the annexation, and directs that notice to be given of the hearing. The hearing will be held at the time of first reading of the annexation and zoning ordinances. A public hearing on the annexation is not required by Colorado law. The property is located within the Fort Collins Urban Growth Area. According to policies and agreements between the City of Fort Collins and Larimer County contained in the Intergovernmental Agreement for the Fort Collins Urban Growth Area, the City will consider annexing property in the UGA when the property is eligible for annexation according to state law. The property became completely surrounded by the City of Fort Collins through the following annexations: N: Harmony Annexation No. 2, September 1977. E: Harmony Annexation No. 3, October 1977. S: Keenland Annexation, August 1980. South Harmony Annexation, February 1986. W: Harmony Annexation, August 1977. DATE: June 20, 1989 -2- I ITEM NUMBER: 22 — Planning and Zoning Board Recommendation: The Planning and Zoning Board will conduct a public hearing on the annexation and zoning at its regular monthly meeting on June 26, 1989, and will make its recommendation at that time. The Board's recommendation will be forwarded to the City Council in time for the public hearing and first readings of the annexatior and zoning ordinances. Box 471 Fort Collins, Colorado • RESOLUTION 89-117 OF THE COUNCIL OF THE CITY OF FORT COLLINS STATING THE INTENT OF THE CITY OF FORT COLLINS TO ANNEX CERTAIN PROPERTY AND INITIATING ANNEXATION PROCEEDINGS FOR SUCH PROPERTY TO BE KNOWN AS THE HARMONY ANNEXATION NO. 7 WHEREAS, the property hereinafter described has, for a period of not less than three (3) years prior to this date, been completely contained within the boundaries of the City of Fort Collins; and WHEREAS, the Council of the City of Fort Collins has determined that it is in the best interests of the citizens of the City to annex said area to the City, as provided by the terms of the Intergovernmental Agreement between the City and Larimer County, Colorado, dated September 7, 1988; and WHEREAS, the Council desires to initiate annexation proceedings in accordance with law. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That, the Council of the City of Fort Collins intends to annex the following described property, to be known as the Harmony Annexation No. 7, situate in the County of Larimer, State of Colorado, to wit. A tract of land situate in the Southeast Quarter of Section 31, Township 7 North, Range 68 West of the 6th P.M., Larimer County, Colorado, which considering the South line of said Southeast quarter as bearing S 89°42'27" E and with all bearings contained herein relative thereto, is contained within the boundary lines which begin at the South quarter corner of said Section 31 and run thence S 89042'27" E 1404.99 feet; thence N 00003'54" E 98.41 feet to the true point of beginning; thence N 83905'23" W 82.43 feet; thence N 00000'43" E 1702.45 feet; thence S 89°56'06" E 110.54 feet; thence S 00°03'54" W 1262.25 feet; thence along the arc of a 3744.83 foot radius curve to the right a distance of 451.11 feet, the long chord of which bears S 03°30'49" W 450.84 feet to the point of beginning. Containing 4.2114 acres. Section 2. That the Council hereby initiates annexation proceedings for the above described property. Section 3. That the Notice attached hereto be adopted as a part of this Resolution. Said Notice establishes the date, time and place when a hearing will be held regarding the passage of an annexation ordinance pertaining to the above described property. The City Clerk is directed to publish a copy of this Resolution and said Notice as provided in Section L.J 31-12-108(2), C.R.S. Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 20th day of June, A.D. 1989. That, on August 1, 1989, at the hour of 6:30 p.m., or as soon thereafter as the matter may come on for hearing in the Council Chambers in the City Hall, 300 Laporte Avenue, Fort Collins, Colorado, the Fort Collins City Council will hold a hearing for the purpose of finding and determining whether the property proposed to be annexed meets the applicable requirements of Colorado law and is considered eligible for annexation.
